واعتمد الفريق العامل المعني بالاحتجاز التعسفي المداولة رقم 9 بشأن تعريف ونطاق الحرمان التعسفي من الحرية، التي جاء فيها أن حظر جميع أشكال الحرمان التعسفي من الحرية يمثل جزءاً من القانون الدولي العرفي ويشكل قاعدة من القواعد القطعية أو الآمرة.
