وإذ تشعر بالقلق إزاء كثرة عدد حالات التبني غير القانوني وعدد الأطفال الذين يشبُّون دون أبوين والأطفال الذين يقعون ضحايا مختلف أشكال العنف والإساءة والاستغلال والإهمال داخل الأسرة وخارجها،

Calls upon States to take necessary measures to prevent and combat illegal adoptions and all adoptions that are not in the best interest of the child, by establishing policy, legislation and effective supervision for the protection of children involved in national and intercountry adoptions, bearing in mind the best interest of the child;
17- يدعو الدول إلى اتخاذ جميع التدابير اللازمة لمنع ومكافحة حالات التبني غير القانوني وجميع حالات التبني التي لا تراعي مصلحة الطفل الفضلى، عن طريق وضع ما يلزم من سياسات وتشريعات وسبل إشراف فعالة من أجل حماية الأطفال المشمولين بالتبني وطنياً وفيما بين البلدان، مع مراعاة مصلحة الطفل الفضلى؛

17. The Committee is concerned that a number of cases of illegal adoptions have been reported recently, and that improperly inducing consent in cases of adoption is not covered by the penal legislation.
26- تعرب اللجنة عن قلقها إزاء الإبلاغ مؤخراً عن عدد من حالات التبني غير القانوني ولأن التشريعات الجزائية لا تغطي الحفز غير اللائق على إقرار تبني طفل.
