5. The accused subsequently refused, or was aware of a refusal, to acknowledge the deprivation of freedom or to give information on the fate or whereabouts of such person or persons.

(i) " Enforced disappearance of persons " means the arrest, detention or abduction of persons by, or with the authorization, support or acquiescence of, a State or a political organization, followed by a refusal to acknowledge that deprivation of freedom or to give information on the fate or whereabouts of those persons, with the intention of removing them from the protection of the law for a prolonged period of time.
(ط) يعني " الاختفاء القسري للأشخاص " إلقاء القبض على أي أشخاص أو احتجازهم أو اختطافهم من قبل دولة أو منظمة سياسية، أو بإذن أو دعم منها لهذا الفعل أو بسكوتها عليه. ثم رفضها الإقرار بحرمان هؤلاء الأشخاص من حريتهم أو إعطاء معلومات عن مصيرهم أو عن أماكن وجودهم، بهدف حرمانهم من حماية القانون لفترة زمنية طويلة.

Good practices of States include the codification of enforced disappearance following the definition given by the Rome Statute ( " the arrest, detention or abduction of persons... followed by a refusal to acknowledge that deprivation of freedom or to give information on the fate or whereabouts of those persons " ), as well as the codification of an autonomous offence including such an element in its definition.

(ز) الإخفاء القسري للأشخاص يعني إلقاء القبض على أشخاص أو احتجازهم أو اختطافهم من قبل الدولة أو منظمة سياسية، أو بإذن أو دعم منها لهذا الفعل أو بسكوتها عنه. ثم رفضها الإقرار بحرمان هؤلاء الأشخاص من حريتهم أو إعطاء معلومات عن مصيرهم أو عن أماكن وجودهم، بهدف حرمانهم من حماية القانون مدة زمنية طويلة " .
