7.4 The Committee considers that the principle established in the above cases also applies in the case of the authors of the present communication, and that the application by the domestic courts of the citizenship requirement violated their rights under article 26 of the Covenant.
7-4 وتعتبر اللجنة أن المبدأ المكرس في القضايا المشار إليها أعلاه ينطبق أيضاً في قضية صاحبي هذا البلاغ، وأن تطبيق المحاكم المحلية لشرط المواطنة ينتهك حقوقهما بموجب المادة 26 من العهد.

They further claim that the directives of the State party regarding classification of secret information and the requirement of the Court in the summary proceedings that the authors prove the negligence of the State party result in a violation of the duty of the State party, under article 2, paragraph 3, of the Covenant, to provide an effective remedy for violation of their rights under article 17.
ويدعيان كذلك أن توجيهات الدولة الطرف بشأن تصنيف المعلومات السرية واشتراط المحكمة في الدعوى العاجلة بأن يثبت مقدما البلاغ إهمال الدولة الطرف، إنما تسفر جميعا عن انتهاك الدولة الطرف لالتزامها بموجب الفقرة 3 من المادة 2 من العهد بتوفير سبيل فعال للانتصاف بخصوص انتهاك حقوقهما بموجب المادة 17.

3. The authors claim that the Czech Republic violated their rights under article 26 of the Covenant in its application of Law No. 87/1991, which requires Czech citizenship for property restitution.
3- يدعي صاحبا البلاغ أن الجمهورية التشيكية انتهكت حقوقهما بموجب المادة 26 من العهد بتطبيقها القانون رقم 87/1991 الذي يشترط أن يكون الشخص الذي يطلب استرداد أملاكه تشيكي الجنسية.

6.5 The Committee notes the authors' claims that they are victims of a violation by Libya of their rights under article 7, in conjunction with article 2, paragraph 3, of the Covenant as a result of the enforced disappearance of their fathers.
6-5 وتحيط اللجنة علماً بادعاءات صاحبي البلاغ بأنهما ضحيتا انتهاك ليبيا حقوقهما بموجب المادة 7، بالاقتران مع الفقرة 3 من المادة 2 من العهد نتيجة الاختفاء القسري لوالديهما.

3.7 The authors contend that they are themselves victims of violations of their rights under article 7 in conjunction with article 2, paragraph 3, of the Covenant, as the enforced disappearance of their fathers has marked their whole lives and caused them ongoing feelings of uncertainty and anguish which still persist.
3-7 ويدعي صاحبا البلاغ أنهما نفساهما ضحيتا انتهاك حقوقهما بموجب المادة 7 بالاقتران مع الفقرة 3 من المادة 2 من العهد، حيث إن الاختفاء القسري لوالديهما أثّر في حياتهما بالكامل وولّد لديهما مشاعر مستمرة من عدم اليقين والكرب لا تزال قائمة.

It is therefore submitted that the State party has violated their rights under article 7 read in conjunction with article 2, paragraph 3, of the Covenant and, until March 1996 and August 1996 respectively, when they attained majority, that the State party has also violated the same rights in conjunction with article 24, paragraph 1, of the Covenant as these two authors were minors in need of special protection.
ولذلك دفعا بأن الدولة الطرف انتهكت حقوقهما بموجب المادة 7 مقروءة بالاقتران مع الفقرة 3 من المادة 2 من العهد، وأنها انتهكت أيضاً، حتى بلوغهما سن الرشد في آذار/مارس 1996 وآب/أغسطس 1996 على التوالي، نفس الحقوق المكفولة بموجب المادة 7 مقترنة بالفقرة 1 من المادة 24 من العهد، لأن صاحبي البلاغ كانا قاصرين وبحاجة إلى حماية خاصة.

140. In cases No. 1304/2004 (Khoroshenko v. Russian Federation) and No. 1503/2006 (Akhadov v. Kyrgyzstan), given that the authors had been sentenced to death following a trial held in violation of fair trial guarantees, the Committee concluded that the authors were also victims of violations of their rights under article 6, read in conjunction with article 14 of the Covenant.
140- وفي القضيتين رقم 1304/2004 (خوروشينكو ضد الاتحاد الروسي)، ورقم 1503/2006 (أخادوف ضد قيرغيزستان)، ونظراً لأن صاحبي البلاغ كان محكوماً عليهما بالإعدام في أعقاب محاكمة انطوت على انتهاك لضمانات المحاكمة العادلة، خلصت اللجنة إلى أن صاحبي البلاغ هما أيضاً ضحية لانتهاك حقوقهما بموجب المادة 6 مقروءة بالاقتران مع المادة 14 من العهد.
