The Committee notes the recent enactment of Organic Law No. 4/2000 on rights and freedoms of foreigners, the implementation of which will be followed closely and with great interest, particularly with respect to regularization schemes for illegal immigrants and the establishment of integration programmes.

the rights and freedoms of aliens and stateless persons permanently resident or temporarily present within the territory of Azerbaijan may only be limited in accordance with the rules of international law and the laws of the Republic of Azerbaijan.
ولا يجوز تقييد حقوق وحريات الأجانب عديمي الجنسية المقيمين بصفة دائمة أو مؤقتة في أراضي أذربيجان إلا وفقاً لقواعد القانون الدولي وقوانين جمهورية أذربيجان.

In particular, article 26 of Organic Law No. 4/2000 of 11 January on the rights and freedoms of foreign nationals in Spain and their social integration stipulates:

20. Title I of the Act on the rights and freedoms of foreigners is based on the principle of the equality of and non-discrimination against foreigners and recognizes that they are entitled to the rights provided for in its articles 3 to 24.
20- يستند الباب الأول من قانون حقوق وحريات الأجانب إلى مبدأ المساواة وعدم التمييز ضد الأجانب، ويعترف لهم بالحقوق المنصوص عليها في مواد القانون من 3 إلى 24.

69. Finally, Spain pointed out that by means of the 2000 Law on the rights and freedoms of foreigners in Spain, the Spanish Observatory on Racism and Xenophobia was established.

368. Royal Decree 2393/2004 of 11 January on the rights and freedoms of foreigners in Spain and their social integration allows victims to request temporary residence if they have a protection order.
368 - ويسمح المرسوم الملكي 2393/2004 المؤرخ 11 كانون الثاني/يناير، بشأن حقوق وحريات الأجانب في إسبانيا واندماجهم الاجتماعي، للضحايا بطلب إقامة مؤقتة إذا كان لديهم أمر حماية.

29. Title I of Organization Act No. 4/2000, as amended by Organization Act No. 8/2000, on the rights and freedoms of foreigners in Spain is based on the principle of equality and nondiscrimination and is applicable to all the rights to which foreigners are entitled.
29- إن الباب الأول من القانون التنظيمي رقم 4/2000، بصيغته المعدلة بالقانون التنظيمي رقم 8/2000، بشأن حقوق وحريات الأجانب في إسبانيا يستند إلى مبدأ المساواة وعدم التمييز ويشمل جميع الحقوق الواجبة للأجانب.

Organic Law 4/2000, of 11 January, which was amended by Organic Law 8/2000, of 22 December, on rights and freedoms of foreigners in Spain and their social integration, is based on the principle of equality and non-discrimination. This law lays down a statute on the rights and freedoms of foreigners in our country.
إن القانون الأساسي 4/2000 المؤرخ 11 كانون الثاني/يناير، والمعدل بالقانون الأساسي 8/2000 المؤرخ 22 كانون الأول/ديسمبر، بشأن حقوق وحريات الأجانب في إسبانيا وإدماجهم في المجتمع، قائم على المبدأ الأساسي للمساواة وعدم التمييز، ويحدد نظام حقوق وحريات الأجانب في بلدانا، دون تمييز بين الجنسين.

Organic Law 4/2000, of 11 January, on the rights and freedoms of foreigners in Spain and their social integration, adds a new Title XV bis to the Penal Code to deal with illegal trafficking in persons.
وبموجب القانون الأساسي 4/2000 المؤرخ 11 كانون الثاني/يناير، بشأن حقوق وحريات الأجانب في إسبانيا وإدماجهم في المجتمع، أدرج في قانون العقوبات فصل جديد هو الفصل الخامس عشر المكرر، ويتصل بالاتجار غير المشروع بالأشخاص الأجانب.

The report also indicates that Royal Decree 2393/2004 on the rights and freedoms of foreigners in Spain and their social integration allowed victims to request temporary residence if they had a protection order (para. 368).

41. Under article 23 of Organization Act No. 4/2000 on rights and freedoms of foreigners in Spain and their Social Integration of 11 January 2000, " Any treatment deriving from the adoption of criteria prejudicial to workers because they are foreign or belong to a specific race, religion, ethnic group or nationality " is considered to be indirect discrimination.
41- أما المادة 23 من القانون التنظيمي رقم 4/2000 بشأن حقوق وحريات الأجانب في إسبانيا وإدماجهم الاجتماعي المؤرخ 11 كانون الثاني/يناير 2000 فتعتبر تمييزاً مباشراً " أية معاملة تستند إلى اعتماد معايير مجحفة للعمال لأنهم أجانب أو لانتمائهم إلى عرق أو دين أو جماعة إثنية أو قومية " .

A recent reform of Organic Law No. 4/2000 on rights and freedoms of foreigners in Spain and their Social Integration (the Aliens Act) enables women victims of gender violence reunited with their families in Spain to receive an independent residence permit after the issuance of a protection order.
وجرى مؤخرا إدخال تعديل على القانون النظامي رقم 4/2000 بشأن حقوق وحريات الأجانب في إسبانيا واندماجهم الاجتماعي (قانون الأجانب) يمكّن النساء من ضحايا العنف المتعلق بنوع الجنس اللاتي يلتحق بأسرهن في إسبانيا من الحصول على تصريح إقامة مستقل بعد إصدار أمر بحمايتهن.

36. This law guarantees the rights and freedoms of foreigners residing in Andorra, pursuant to article 39.2 of the Constitution, which states: " Aliens legally resident in Andorra can freely exercise the rights and freedoms recognized in chapter III of this title. "
36- ويضمن هذا القانون حقوق وحريات الأجانب المقيمين في أندورا، وفقا لما تنص عليه المادة 39-2 من الدستور: " يجوز للأجانب المقيمين بصفة قانونية في أندورا أن يمارسوا بحرية حقوقهم وحرياتهم المنصوص عليها في الفصل الثالث من هذا الباب " .

2. In addition, under the domestic legal system, ample protection for the rights of migrants is provided in the Spanish Constitution, in Organization Act No. 4/2000 of 11 January, on the rights and freedoms of aliens in Spain and their social integration, and in its implementing regulations, especially since the most recent amendment (Organization Act No. 2/2009 of 11 December).
2- إضافة لذلك، وفي إطار النظام القانوني الوطني، يُنص على حماية وافية لحقوق المهاجرين في الدستور الإسباني وفي القانون التنظيمي رقم 4/2000 المؤرخ 11 كانون الثاني/يناير، حول حقوق وحريات الأجانب في إسبانيا واندماجهم الاجتماعي، وفي اللوائح التنفيذية لهذا المرسوم، وخاصة منذ صدور تعديلاته الأخيرة (القانون التنظيمي رقم 2/2009 المؤرخ 11 كانون الأول/ديسمبر)().

174. These Acts, which were drawn up with the active participation of the Office of the United Nations High Commissioner for Refugees (UNHCR), enshrine the rights and freedoms of foreign nationals and stateless persons present in the territory of Belarus.
