2.2 On 3 February 2004, the Immigration Division of the Immigration and Refugee Board issued departure orders against them because they had not met the conditions to stay in Canada as entrepreneurs within the two-year period after arrival prescribed by the Immigration and Refugee Protection Act (IRPA, or the Immigration Act), in force at the time.

On 31 March 2005, he filed an application pursuant to s. 84 (2) of the Immigration and Refugee Protection Act for release as a foreign national who has not been removed from Canada within 120 days after the Federal Court determines a certificate to be reasonable.

However, the Public Prosecution Service of Canada (federal prosecutors) and federal policing (Royal Canadian Mounted Police) are also responsible for the investigation and prosecution of Criminal Code offences, in certain instances, as well as the prosecution of other federal criminal offences (including the trafficking in persons offence contained in the Immigration and Refugee Protection Act).
