A suggestion to replace the words " transit State " by " States Parties " was objected to on the grounds that it would wrongly equate the obligations of transit States with those of the host State in article 4.
واقترح الاستعاضة عن عبارة " دولة المرور العابر " بعبارة " الدول اﻷطراف " . وأثير اعتراض على هذا الاقتراح على أساس أنه يساوي خطأ بين التزامات دول المرور العابر والتزامات الدولة المضيفة في المادة ٤.

36. Chapter IV, which consisted of a single draft article, concerned the protection in the transit State of an alien subject to expulsion.
٣٦ - ويتعلق الفصل الرابع، الذي يتألف من مشروع مادة واحدة، بتوفير الحماية في دولة المرور العابر للأجنبي الخاضع للطرد.

The Special Rapporteur endorses this view but considers it appropriate to expand the scope of the transit State's obligations to include all the rules of international human rights law to which it is subject, not merely those contained in instruments to which it is a party.

In its declaration Pakistan stated that " the Convention, while dealing with transit through the territory of the transit State, fully safeguards the sovereignty of the transit State.

" ٢ - يُقصد بتعبير `دولة المرور العابر` أي دولة يمر بإقليمها مرورا عابرا أو يتواجد فيها مؤقتا موظفو اﻷمم المتحدة واﻷفراد المرتبطون بها، بخلاف الدولة التي تجري العملية في إقليمها. "

The point was made, in particular, that human rights rules applicable in the expelling State did not apply as such in the transit State, which was obliged only to observe its own domestic laws and the rules set out in international instruments to which it was itself a party.
وأعرب على وجه الخصوص عن رأي مفاده أن قواعد حقوق الإنسان السارية في الدولة القائمة بالطرد لا تسري في حد ذاتها على دولة المرور العابر التي تلزم فقط بالتقيد بقوانينها الوطنية والقواعد المنصوص عليها في الصكوك الدولية التي تعد تلك الدولة طرفا فيها.

Draft articles F1 and H1, on protecting the human rights of aliens subject to expulsion in the transit State, and their right of return to the expelling State, should be clarified.
وينبغي توضيح مشروع المادتين واو -1 وحاء -1 المتعلقين بحماية حقوق الإنسان الخاصة بالأجنبي المطرود في دولة المرور العابر وبحقه في العودة إلى الدولة الطاردة.

D. Protection in the transit State

The definitions of " host State " and " transit State " in subparagraphs (d) and (e) were considered acceptable.

22. While some delegations expressed support for draft article F1 on the human rights obligations of the State of transit, some other delegations believed that the exact wording of this provision should be reconsidered.
22 - وبينما أعرب بعض الوفود عن تأييد مشروع المادة واو 1 المتعلق بالتزامات دولة المرور العابر في مجال حقوق الإنسان، أعرب بعض الوفود الأخرى عن الاعتقاد بأنه ينبغي إعادة النظر في دقة صياغة ذلك النص.

8. The draft convention should provide for a mechanism that would make the presence of individuals or of non-governmental organizations in a transit or host State conditional on the consent of the State concerned.
