3/ With regard to awards made in the territory of non-contracting States, State will apply the Convention only to the extent to which these States grant reciprocal treatment.
)٣( بالنسبة لقرارات التحكيم الصادرة في أراضي دول غير متعاقدة ، فان الدولة لا تطبق الاتفاقية الا بقدر وفاء هذه الدول بشرط المعاملة بالمثل .

وقيل ان اشتراط أن يكون المحال اليه أيضا موجودا في دولة متعاقدة سيسبب عدم يقين بشأن انطباق مشروع الاتفاقية ، ﻷن الممول المحتمل لا يمكنه أن يتنبأ بما ان كان سيوجد محال اليهم متنافسون من دول غير متعاقدة لا يكون تنازع اﻷولوية معهم خاضعا لمشروع الاتفاقية .
