First, the Panel is called upon to interpret the clause “without prejudice to the debts and obligations of Iraq arising prior to 2 August 1990” (hereinafter referred to as the “arising prior to” clause).

(a) The phrase " without prejudice to the debts and obligations of Iraq arising prior to 2 August 1990, which will be addressed through normal mechanisms " was intended to have an exclusionary effect on the Commission's jurisdiction, i.e. such debts and obligations are not compensable by the Commission;
(أ) القصد من عبارة " دون المساس بديون والتزامات العراق الناشئة قبل 2 آب/أغسطس 1990 والتي سيجري تناولها عن طريق الآليات العادية " هو أن يكون لها أثر استبعادي يقيد نطاق اختصاص اللجنة بمعنى أن تكون هذه الديون والالتزامات غير قابلة للتعويض من جانبها؛

(a) The phrase " without prejudice to the debts and obligations of Iraq arising prior to 2 August 1990, which will be addressed through normal mechanisms " was intended to have an exclusionary effect on the Commission's jurisdiction, i.e. that such debts and obligations could not be brought before the Commission;
(أ) أُريد بالعبارة " دون المساس بديون العراق والتزاماته الناشئة قبل 2 آب/أغسطس 1990 والتي سيجري تناولها عن طريق الآليات العادية " أن يكون لها أثر استبعادي في ولاية اللجنة، أي أن هذه الديون والالتزامات لا يمكن أن تعرض على اللجنة؛

Iraq, without prejudice to the debts and obligations of Iraq arising prior to 2 August 1990, which will be addressed through the normal mechanisms, is liable under international law for any direct loss, damage ... or injury to foreign Governments, nationals and corporations, as a result of Iraq’s unlawful invasion and occupation of Kuwait”.
العراق، دون المساس بديون والتزامات العراق الناشئة قبل 2 آب/أغسطس 1990 والتي سيجري تناولها عن طريق الآليات العادية، مسؤول بمقتضى القانون الدولي عن أي خسارة مباشرة أو ضرر مباشر، ... أو ضرر وقع على الحكومات الأجنبية أو رعاياها أو شركاتها، نتيجة لغزو العراق واحتلاله غير المشروعين للكويت " .

(أ) كان الغرض من جملة " دون المساس بديون والتزامات العراق الناشئة قبل 2 آب/أغسطس 1990 والتي سيجري تناولها عن طريق الآليات العادية " ، هو أن يكون لها أثر استبعادي على اختصاص اللجنة، أي أن مثل هذه الديون والالتزامات غير قابلة للتعويض من قِبَل اللجنة؛
