Clarification of the basis for the proposed change to regulation 9.3, namely that continuing appointments could be terminated in the interest of the good administration of the Organization without the consent of the staff member concerned, should be provided to the General Assembly, given the change that that amendment made to existing practice.

The Advisory Committee notes that, unlike continuing appointments, permanent appointments cannot be terminated in the interest of the good administration of the Organization without the consent of the staff member (see staff regulation 9.3 (b)).
وتلاحظ اللجنة الاستشارية أن التعيينات الدائمة، بخلاف التعيينات المستمرة، لا يمكن إنهاؤها تحقيقا لحسن سير العمل بالمنظمة من دون موافقة الموظف المعني (انظر البند 9/3 (ب) من النظام الأساسي لموظفي الأمم المتحدة).

(b) In addition, in the case of a staff member holding a continuing appointment, the Secretary-General may terminate the appointment without the consent of the staff member if, in the opinion of the Secretary-General, such action would be in the interest of the good administration of the Organization, to be interpreted principally as a change or termination of a mandate, and in accordance with the standards of the Charter;
(ب)علاوة على ذلك، يجوز للأمين العام أن ينهي تعيين الموظف المعين تعيينا مستمرا دون موافقة الموظف إذا كان الغرض من هذا الإجراء، في رأي الأمين العام، هو لصالح حُسن إدارة المنظمة وأنه اتخذ وفقا لمعايير الميثاق ويفسر بصفة رئيسية باعتباره تغييرا في الولاية أو إنهاء لها؛
