For both of these groups, it is the primary duty and responsibility of the competent authorities, as reflected in Guiding Principle 28, to provide the means which allow internally displaced persons to return voluntarily, in safety and with dignity, to their homes or places of habitual residence, or to resettle voluntarily in another part of the country, and to facilitate the reintegration of both groups.
وأول واجبات ومسؤوليات السلطات المعنية بالنسبة إلى هاتين الفئتين هي، كما ورد في المبدأ التوجيهي 28، توفير الوسائل التي تسمح للمشردين داخلياً بالعودة الطوعية في كنف الأمان والكرامة إلى ديارهم أو أماكن إقامتهم العادية أو إعادة الاستيطان الطوعي في مكان آخر من البلد، وتيسير إعادة إدماج الفئتين.

1. Internally displaced persons who have returned to their homes or places of habitual residence or who have resettled in another part of the country shall not be discriminated against as a result of their having been displaced.
1- لا يجوز التمييز ضد الأشخاص المشردين داخلياً الذين عادوا إلى ديارهم أو أماكن إقامتهم المعتادة أو المعاد توطينهم في مكان آخر من البلد، بحكم وضعهم السابق كمشردين.

“Conscious that serious human rights violations and breaches of international humanitarian law are among the reasons why people flee their homes or places of habitual residence and become refugees or internally displaced persons,
" وإذ تعي أن الانتهاكات الخطيرة لحقوق الإنسان، وحالات خرق القانون الإنساني الدولي، تعد من بين الأسباب التي تدفع الأشخاص للفرار من ديارهم أو أماكن إقامتهم المعتادة ليصبحوا لاجئين أو مشردين داخلياً،

The Representative urges the Government to continue to take all necessary steps to ensure that the conditions for sustainable return are created, allowing IDPs to return voluntarily, in safety and with dignity, to their homes or places of habitual residence.
ويحثُّ الممثل الحكومة على مواصلة اتخاذ جميع الخطوات الضرورية لضمان تهيئة الظروف اللازمة للعودة المستدامة، وتمكين المشردين داخلياً من العودة طواعيةً بسلامة وكرامة إلى ديارهم أو أماكن إقامتهم الاعتيادية.

“9. Confirms that where displaced persons voluntarily settle elsewhere, this does not affect their right to return to their home or place of habitual residence, nor their right to property restitution or, should this not be possible, compensation or other form of just reparation;
" 9- تؤكد أنه في الحالات التي يستقر فيها المشردون طوعاً في مكان آخر، فإن هذا لا يمس حقهم في العودة إلى ديارهم أو أماكن إقامتهم المعتادة، أو حقهم في رد ممتلكاتهم، أو، إذا تعذر ذلك، في التعويض، أو أي شكل آخر من أشكال الجبر العادل؛

12. Recognizes that displaced persons may choose voluntarily to exchange their property rights over their original homes or places of habitual residence for the same or similar rights over another property or undertake other possible transactions, on condition that such decisions are knowingly and voluntarily taken;
12- تسلِّم بأن الأشخاص المشردين قد يختارون طوعاً الاستعاضة عن حقوقهم في ملكية ديارهم أو أماكن إقامتهم المعتادة مقابل حقوق مماثلة أو مشابهة في ممتلكات أخرى أو إجراء صفقات أخرى محتملة، بشرط أن تُتَّخذ مثل هذه القرارات عن علم وبصورة طوعية؛

1- يقع على عاتق السلطات المختصة، في المقام الأول، واجب ومسؤولية تهيئة الظروف وتوفير الوسائل لتمكين المشردين داخلياً من العودة الطوعية، آمنين مكرّمين، إلى ديارهم أو أماكن إقامتهم المعتادة أو التوطن الطوعي في مكان آخر من البلد.

2. Principle 28 recognizes that the competent authorities have the primary duty and responsibility to establish conditions, as well as provide the means, which allow IDPs to return voluntarily, in safety and with dignity, to their homes or places of habitual residence, or to resettle voluntarily in another part of the country.

وتعرّف المبادئ التوجيهية " المشردين داخليا " بأنهم " أشخاص أو مجموعة من الأشخاص أكرهوا أو أُجبروا على الفرار من ديارهم أو أماكن إقامتهم الاعتيادية، أو على مغادرتها، لا سيما نتيجة لكوارث طبيعية أو ناجمة عن أنشطة بشرية، أو تفاديا لآثارها، لم يعبروا حدود الدولة المعترف بها دوليا " .

54. The term " internally displaced persons " refers to persons or groups of persons who have been forced or obliged to flee or to leave their homes or places of habitual residence, in particular as a result of or in order to avoid the effects of armed conflict, situations of generalized violence, violations of human rights or natural or human-made disasters, and who have not crossed an internationally recognized State border.

According to the revised definition, the internally displaced are “persons or groups of persons who have been forced or obliged to flee or to leave their homes or places of habitual residence, in particular as a result of, or in order to avoid the effects of armed conflict, situations of generalized violence, violations of human rights or natural or human-made disasters, and who have not crossed an internationally recognized State border”.
وطبقاً للتعريف المنقح، يقصد بالمشردين داخلياً " اﻷشخاص أو مجموعات اﻷشخاص الذين حُملوا أو أُجبروا على الفرار أو على مغادرة ديارهم أو أماكن اقامتهم العادية، خاصة نتيجة، أو تجنباً ﻵثار نزاع مسلح، أو حالات من العنف الشامل، أو انتهاكات حقوق اﻹنسان، أو كوارث طبيعية أو من صنع اﻹنسان، ولم يعبروا حدود دولة معترف بها دولياً " .

Recommendation Rec (2006) 6 adopted by the Committee of Ministers of the Council of Europe on 5 April 2006, while supporting the United Nations guidelines, declares in paragraph 12 that, " Internally displaced persons have the right to return voluntarily, in safety and in dignity, to their homes or places of habitual residence, or to resettle in another part of the country in accordance with the European Convention on Human Rights " .
التوصية رقم 6 لعام 2006 التي اعتمدتها لجنة وزراء مجلس أوروبا في 5 نيسان/أبريل 2006 تنص في الفقرة 12، مع تأييدها لمبادئ الأمم المتحدة التوجيهية، على أن " للمشردين داخلياً الحق في العودة الطوعية، آمنين مكرَّمين، إلى ديارهم أو أماكن إقامتهم المعتادة، أو في الاستيطان في منطقة أخرى من البلد وفقاً للاتفاقية الأوروبية لحقوق الإنسان " ().

11. Confirms that where displaced persons voluntarily settle elsewhere, this does not affect their right to return to their home or place of habitual residence, nor their right to housing and property restitution or, should this not be possible, just compensation or other form of just reparation;
11- تؤكد أنه عندما يستقر الأشخاص المشردون في أماكن أخرى بصورة طوعية، فإن هذا لا يمس حقهم في العودة إلى ديارهم أو أماكن إقامتهم المعتادة، أو حقهم في الإسكان واسترداد الممتلكات، أو إذا تعذَّر ذلك، حقهم في التعويض العادل أو أي شكل آخر من أشكال الجبر المنصف؛

3. Reaffirms that all those displaced have the right to adequate housing and property restitution or, should this not be possible, appropriate compensation or another form of just reparation, and the particular importance of these rights for displaced persons wishing to return to their original homes or places of habitual residence;
3- تؤكد من جديد أن جميع أولئك المشردين لهم الحق في مسكن ملائم واسترداد ممتلكاتهم، أو إذا تعذّر ذلك، في تعويض مناسب أو أي شكل آخر من أشكال الجبر المنصف، وتؤكد الأهمية الخاصة لهذه الحقوق بالنسبة للأشخاص المشردين الراغبين في العودة إلى ديارهم أو أماكن إقامتهم المعتادة؛
