3. " Explosive submunition " means a conventional munition that in order to perform its task is dispersed or released by a cluster munition and is designed to function by detonating an explosive charge prior to, on or after impact;

4. " Failed cluster munition " means a cluster munition that has been fired, dropped, launched, projected or otherwise delivered and which should have dispersed or released its explosive submunitions but failed to do so;

5. `Unexploded submunition'means an explosive submunition which has been dispersed or released by, or otherwise separated from, a cluster munition during an armed conflict and has failed to explode as intended.
5- يُقصد ﺑ `الذخيرة الفرعية غير المنفجرة` ذخيرة فرعية متفجرة نُثرت أو أُطلقت أو انفصلت بطريقة أخرى عن ذخيرة عنقودية خلال نزاع مسلح، لكنها لم تنفجر كما كان مقصوداً.

(b) not transfer any cluster munition that does not meet its design specifications, or that has been designated for destruction;
(ب) عـدم نقـل أي ذخيرة عنقودية لا تستوفي مواصفات تصميمها، أو وُجِّهت للتدمير؛

(c) not transfer any cluster munition or submunition to any recipient other than a State or State agency authorized to receive such transfers;
(ج) عدم نقل أي ذخيرة عنقودية أو ذخيرة فرعية إلى أي متلق غير دولة أو وكالة تابعة لدولة مرخص لها بتلقي هذه المنقولات؛

(d) prevent unauthorised transfers, from areas under its jurisdiction or control, of any cluster munition or sub-munition; and
(د) منع عمليات النقل غير المرخَّص بها لأي ذخيرة عنقودية أو ذخيرة فرعية، من مناطق خاضعة لولايته أو لسيطرته؛

4- يُقصد ﺑ `الذخيرة الفرعية غير المنفجرة` ذخيرة فرعية متفجرة نُثرت أو أُطلقت من ذخيرة عنقودية أو انفصلت بطريقة أخرى عنها خلال نزاع مسلح، ولم تنفجر كما كان مقصوداً.

(a) not transfer any cluster munition manufactured before 1990 except pursuant to security cooperation agreements or arrangements existing at the time of the entry into force of this Protocol;
(أ) عدم نقل أي ذخيرة عنقودية مصنعة قبل عام 1990 إلا إذا كان ذلك عملاً باتفاقات أو ترتيبات التعاون الأمني القائمة عند بدء نفاذ هذا البروتوكول؛

(b) not transfer any cluster munition that does not meet its design specifications,

(c) not transfer any cluster munition that has been designated for destruction, except for the purposes of destruction pursuant to paragraph 10 of this article;
