The Working Group considers that maintaining a person in detention once his release has been ordered by the court competent to exercise control over the legality of detention renders the deprivation of liberty arbitrary.
ويرى الفريق العامل أن إبقاء أي شخص رهن الاحتجاز بعد صدور أمر بالإفراج عنه من محكمة مختصة بممارسة الرقابة على مدى قانونية إجراء الاحتجاز يجعل الحرمان من الحرية إجراءً تعسفياً.

7.5 The Committee notes that the author remains in detention following completion of the minimum 10-year period of preventive detention, due to the absence of a sufficient release plan showing the supervision and support necessary for his re-integration in society.
7-5 وتلاحظ اللجنة أن صاحب البلاغ لا يزال رهن الاحتجاز بعد انتهاء فترة الحبس الاحتياطي الدنيا المحددة بعشر سنوات بسبب عدم وجود خطة كافية للإفراج عنـه تتضمن ما يلزم من إشراف ودعم لإعادة اندماجه في المجتمع.
