سابعا - مدى إمكانية مثول زعماء الخمير الحمر أمام القضاء

105. The Group notes that its mandate calls for recommendations regarding bringing " Khmer Rouge leaders " to justice.
٥٠١ - ويلاحظ الفريق أن ولايته تدعو إلى تقديم توصيات بشأن مثول " زعماء الخمير الحمر " أمام القضاء.

Moreover, the logical consequence of such an argument is that, because nearly all Khmer Rouge leaders have agreed to surrender, no prosecutions should take place.

والتقى الممثل الخاص أيضا بممثلين عن برنامج المساعدة العسكرية الفرنسي ومع بعثة زائرة من الخبراء القانونيين الفرنسيين حول مسألة محاكمة زعماء الخمير الحمر.

39. The Group of Experts reported that the feasibility of apprehending Khmer Rouge leaders depended on the ability and the willingness of the Governments in whose territory the suspects were located to arrest or extradite them.
٩٣ - أشار فريق الخبراء إلى أن إمكانية القبض على زعماء الخمير الحمر تعتمد على قدرة الحكومات التي يقيم المشتبه فيهم بأراضيها على القبض عليهم أو تسليمهم، وعلى مدى رغبتها في ذلك.

They concluded that the Cambodian Government was able to apprehend Khmer Rouge leaders in its territory whose whereabouts were known and who were not protected physically from arrest.
