By virtue of this article and related article 16, States parties must guarantee the right of any individual who alleges that he/she has been subjected to torture or cruel, inhuman or degrading treatment or punishment to complain and to have his/her case promptly and impartially investigated, as well as the protection of the complainant and witnesses against illtreatment or intimidation.
22- بمقتضى هذه المادة والمادة 16 التي لها صلة بها، يتعين على الدول الأطراف أن تكفل حق أي فرد يدعي أنه تعرض للتعذيب أو غيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة في أن يقدم شكوى وأن يُجرى تحقيق فوري ونزيه في قضيته وأن تضمن حماية المشتكي والشهود من سوء المعاملة أو التخويف.

Individuals who allege to have been subjected to torture should have their case promptly and impartially investigated and examined by a competent authority and measures should be taken to ensure their protection against ill-treatment or intimidation and degrading treatment as a consequence of their complaint or any evidence given.
وينبغي أن تقوم السلطات المعنية فورا بالتحقيق والنظر بصورة محايدة في قضايا الأشخاص الذين يدَّعون الخضوع للتعذيب، وأن تُتخذ تدابير لكفالة حمايتهم من سوء المعاملة أو التخويف والمعاملة المهينة نتيجة لشكواهم أو لأية أدلة يتم تقديمها.
