Recalling its general recommendation No. 31 (2005) on racial discrimination in the administration and functioning of the criminal justice system, the Committee emphasizes that the absence of complaints concerning acts of racial discrimination is not necessarily an indicator of the absence of racial discrimination in the State party.
تلاحظ اللجنة، في معرض تذكيرها بتوصيتها العامة رقم 31(2005) بشأن منع التمييز العنصري في الإدارة وسير عمل نظام العدالة الجنائية، أن عدم رفع شكاوى تتعلق بالتمييز العنصري لا يُشكّل بالضرورة مؤشراً على عدم وجود تمييز عنصري في الدولة الطرف.

The Committee also notes that, among the high number of 42,260 applications from citizens received by the Ombudsperson during the reporting period, there were no complaints of racial discrimination (arts. 2 (1) (d) and 6).
كما تلاحظ اللجنة عدم وجود شكاوى تتعلق بالتمييز العنصري (المادة 2(1)(د) والمادة 6) ضمن العدد الكبير من الشكاوى التي قدمها مواطنون إلى أمين المظالم أثناء الفترة المشمولة بالتقرير وبلغت 260 42 شكوى.

19. While noting that the High Committee on Human Rights and Fundamental Freedoms has received over 4,100 complaints of violations of rights since the last concluding observations, the Committee notes the information provided by the delegation on the absence of complaints of racial discrimination.
19- واللجنة إذ تلاحظ أن الهيئة العليا لحقوق الإنسان والحريات الأساسية قد تلقت أكثر من 100 4 شكوى تتعلق بانتهاكات لحقوق الإنسان منذ صدور آخر تعليقات ختامية، تحيط علماً بما قدمه الوفد من معلومات عن عدم وجود شكاوى تتعلق بالتمييز العنصري.

13. HR Committee regretted that the Federal Commission against Racism (FCR) did not have a mandate to initiate legal action on complaints of racial discrimination and incitement to racial or religious hatred, and recommended reinforcement of its mandate or the creation of an independent mechanism with competence to initiate such action.
13- وأعربت اللجنة المعنية بحقوق الإنسان عن الأسف لأن اللجنة الاتحادية لمكافحة العنصرية ليست لديها ولاية لرفع دعاوى قانونية بشأن شكاوى تتعلق بالتمييز العنصري والتحريض على الكراهية العنصرية أو الدينية، وأوصت بتعزيز ولاية هذه اللجنة أو إنشاء آلية مستقلة تخول اختصاص رفع تلك الدعاوى(24).
