191. That is to say, as a general rule the confiscated items are turned over to the authority requesting the extradition, but, exceptionally, the Extradition Committee may deem it necessary to retain them or to ask the requesting authority to return them.

Article 2 of the Act furthermore provides that extradition is permitted in two cases: first, where the offence was committed in the State requesting the extradition or the perpetrator is a national of that State and, second, where the offence was committed outside the requesting State and it damaged that State's security, financial position or the authoritative nature of its official stamps.

129. Under the Code of Criminal Procedure, the extradition of a suspect to a requesting State is conditional on the existence of a treaty between that State and Egypt.

It regrets that jurisdiction over offences under the Optional Protocol necessitates double criminality and the extradition is subject to the existence of a treaty between the State party and the requesting State.
وتأسف اللجنة لأن ممارسة الولاية القضائية على الجرائم، المحددة بموجب البروتوكول الاختياري تستلزم التجريم المزدوج، ولأن تسليم المجرمين يخضع، لوجود معاهدة بين الدولة الطرف والدولة طالبة التسليم.

31. With regard to foreign nationals, the question of their extradition to the requesting State is handled in accordance with the following mechanism:
31 - وبالنسبة للشخص الأجنبي، فإن موضوع تسليمه إلى الدولة طالبة التسليم يتم وفقا للآلية الآتية:

Accordingly, a number of States supported a narrower obligation, such as imposing the duty to prosecute only where extradition was denied on grounds of nationality and only when the requesting State asked the State of nationality to prosecute.
وتبعا لذلك، أيد عدد من الدول تضييق الالتزام، من قبيل فرض واجب المحاكمة فقط حيثما لا يجوز التسليم على أساس الجنسية، وفقط عندما تطلب الدولة طالبة التسليم من دولة الجنسية إجراء محاكمة.

1. Is accused of committing an offence which took place inside or outside the territory of the State requesting the extradition and which carries a penalty of not less than two years' imprisonment under the laws of the requesting State and the laws of the Republic of Iraq; or
1- متهماً بارتكاب جريمة وقعت داخل ارض الدولة طالبة التسليم أو خارجها وكانت قوانين الدولة الطالبة وقوانين جمهورية العراق تعاقب عليها بالسجن أو الحبس مدة لا تقل عن سنتين أو أية عقوبة أشد.

" 1. Is accused of committing an offence which took place either inside or outside the State requesting the extradition and which carries a minimum penalty of 2 years' ordinary or rigorous imprisonment under the laws of the requesting State and the laws of Iraq;
1- متهماً بارتكاب جريمة وقعت داخل أرض الدولة طالبة التسليم أو خارجها وكانت قوانين الدولة الطالبة وقوانين جمهورية العراق تعاقب عليها بالسجن أو الحبس مدة لا تقل عن سنتين أو أية عقوبة أشد؛

114. Under the Code of Criminal Procedure, the extradition of a suspect to a requesting State is conditional on the existence of a valid treaty between that State and Iraq.
114- وفقاً لقانون أصول المحاكمات الجزائية يكون تسليم المتهمين إلى الدولة الطرف طالبة التسليم مشروطة بوجود معاهدة نافذة بينها وبين العراق.

41. Accused persons may be extradited to a requesting State in the event that an extradition treaty between the requesting State and the Government of the Republic of Iraq is in force, in accordance with the Code of Criminal Procedure (Act No. 23 of 1971) which prohibits extradition for political or military offences.
41- بالنسبة لتسليم الأشخاص المتهمين، يكون تسليم المتهمين إلى الدولة الطرف طالبة التسليم مشروطاً بوجود معاهدة نافذة بينها وبين حكومة جمهورية العراق وذلك وفقاً لقانون الإجراءات الجنائية المنصوص عليها بقانون أصول المحاكمات الجزائية رقم 23 لسنة 1971 والذي يمنع التسليم في حالة الجريمة السياسية والعسكرية.
