1. The procuring entity shall solicit proposals by causing an invitation to participate in the request-for-proposals-without-negotiation proceedings to be published in accordance with paragraph 1 of article 35 of this Law, unless an exception provided for in that article applies.
1- تَلتمس الجهةُ المشترية الاقتراحات بواسطة التكفّل بنشر دعوة إلى المشاركة في إجراءات طلب الاقتراحات غير المقترن بتفاوض وفقاً للفقرة 1 من المادة 35 من هذا القانون، إلاَّ في حال انطباق استثناء تنصُّ عليه تلك المادة.

The differences between this procurement method and the request for proposals with dialogue method in article 43 on the one hand, and the similarities and differences between this procurement method and the request for proposals without negotiation method in article 41 on the other hand, were highlighted in this regard.

The 2011 Model Law has also introduced conditions for use of two other request-for-proposals types of proceedings (not found in the 1994 Model Law): request for proposals without negotiation, and request for proposals with consecutive negotiations (see articles 29(3) and 30(3) of the 2011 text).

Concern was raised that the reference to direct solicitation in paragraph (1) (b) would be difficult to reconcile in the context of request for proposals without negotiation.

4. The Model Law also provides for the procurement methods " request for quotations " and " request for proposals without negotiation " (article 28).
4- وينصّ القانون النموذجي أيضا على طريقتي الاشتراء المتمثّلتين في " طلب عروض الأسعار " و " طلب الاقتراحات غير المقترن بتفاوض " (المادة 28).

In the 2011 text, all stages preceding the negotiations on the financial aspects of the proposals are the same as in request for proposals without negotiation (2011 article 50 cross-refers therefore to the relevant provisions of 2011 article 47).
ذلك أنَّ نص قانون 2011 يشير إلى أنَّ جميع المراحل التي تسبق المفاوضات بشأن الجوانب المالية للاقتراحات هي ذاتها التي تتضمنها طريقة طلب الاقتراحات غير المقترن بتفاوض (وبذلك تحيل المادة 50 من قانون 2011 إلى الأحكام ذات الصلة الواردة في المادة 47 منه).

The following amendments were proposed to the last two sentences of paragraph 5 of the commentary to article 28 (3): " Enacting States should be aware nevertheless that some multilateral development banks are of the view that the use of procurement methods sharing features of request for proposals without negotiation as provided for in the revised Model Law may apply only to the procurement of routine advisory services.
