Article 21. Conditions for use of request for quotations
المادة 21- شروط استخدام طلب عروض الأسعار

It was pointed out that the Model Law as well, for example in article 50, referred to the desirable minimum of participants in some procurement methods, such as at least three participants where possible in a request for quotations procedure.
وأوضح أن القانون النموذجي يشير أيضا في المادة 50، مثلا، إلى العدد الأدنى المستصوب في بعض أساليب الاشتراء، ومن قبيل ذلك ألا يقل عدد المشتركين عن ثلاثة، إذا تسنى ذلك، في إجراء طلب عروض الأسعار.

It was also noted that the Guide would explain that if, for example, only one or two quotations were received as a result of the request for quotations addressed to three or more suppliers, the procurement could nonetheless continue.
وأشير أيضا إلى أن الدليل سيوضح أنه مثلا في حالة ما إذا ورد عرض أسعار واحد أو عرضان بعد طلب عروض الأسعار من ثلاثة مورّدين أو أكثر، فيمكن لعملية الاشتراء أن تمضي رغم ذلك.

3. Where no alternatives are available, the procurement regulations must regulate the manner in which the participants are to be identified, to ensure that the selection of participants in request-for-quotations proceedings is not carried out in a way so as to restrict market access or to allow abuse of the procedures.
3- وعندما لا تتوافر البدائل، يجب أن تنظم لوائح الاشتراء طريقة تحديد المشاركين لضمان عدم اختيار المشاركين في إجراءات طلب عروض الأسعار بطريقة تقيّد سبل الوصول إلى الأسواق أو تفسح المجال أمام إساءة استخدام الإجراءات.

It was explained that the provisions were relevant in the context of low-value procurement and thresholds envisaged by the draft revised Model Law for recourse to domestic procurement, restricted tendering or request for quotations proceedings.

The wording of the article has been amended so as to allow the use of request for quotations for all types of standardized or common procurement that is not tailored by means of specifications or technical requirements.

An ERA is likely also to be available as a phase in request for quotations or restricted tendering, because the evaluation criteria are quantifiable as its conditions for use require.
ومن المرجح أيضاً أن تكون طريقة المناقصة الإلكترونية متاحة للاستخدام كمرحلة عند استخدام طريقة طلب عروض الأسعار أو طريقة المناقصة المحدودة؛ وذلك لأنَّ المعايير التقييمية قابلة للتقدير الكمي حسبما هو مطلوب في شروط استخدامها.

However, if sufficient numbers are invited to participate in restricted tendering, an equivalent level of competition may be assured; the nature of the market may be such that even the numbers invited to participate in a request for quotations procedure will also ensure equivalent competition.
لكن إذا دعي عددٌ كاف إلى المشاركة في مناقصة محدودة قد يُكفل عندئذ مستوى تنافس معادلٌ لهذا القدر الأقصى؛ بل إنَّ طبيعة السوق في حدّ ذاتها قد تجعل الأعدادَ المدعوة إلى المشاركة في طريقة طلب عروض الأسعار تكفل هي الأخرى مستوى تنافس معادلاً.

request for quotations and ERAs could be used instead of single-source procurement where the need for off-the-shelf items arose in situations of urgency, emergency and the protection of essential security interests of the enacting State.
