وقررت المحكمة استبقاء عاشوروف رهن الاحتجاز.

Ashurov and both of his counsel three times moved for the court to step down but these motions were rejected.
وطلب عاشوروف ومحامياه إلى المحكمة في ثلاث مناسبات أن تعتكف عن النظر في القضية، غير أن هذه الطلبات قوبلت بالرفض.

There is no information before the Committee that, despite their having being raised by Ashurov and his defence, these matters were taken into account either during the second trial or by the Supreme Court.
ولم تتلق اللجنة أية معلومات تفيد بأن هذه المسائل قد أُخذت بعين الاعتبار خلال المحاكمة الثانية أو في إطار إجراء الاستئناف أمام المحكمة العليا، رغم إثارتها من قِبل السيد عاشوروف ودفاعه.

According to the State party, the rights of Mr. Ashurov, as protected by national and international law, have been respected.
ووفقاً للدولة الطرف فإن حقوق السيد عاشوروف قد احتُرمت على النحو الذي يكفله القانون الوطني والدولي.

Neither Mr. Ashurov nor his lawyers complained about this during the preliminary investigation.
ولم تُقدّم أية شكوى لا من السيد عاشوروف ولا من محاميه بشأن ذلك أثناء التحقيق الأولي.

Mr. Ashurov confessed guilt freely, in the presence of his lawyer, who had represented him since the initiation of the investigation.
واعترف السيد عاشوروف بأنه مُذنب بملء حريته وبحضور محاميه الذي كان يمثله منذ بداية التحقيق.

In the light of these considerations, the State party considers that there is no basis for the re-examination of Mr. Ashurov's criminal case or for his compensation.
وفي ضوء هذه الاعتبارات تعتبر الدولة الطرف أنه لا يوجد أي أساس لإعادة النظر في القضية الجنائية للسيد عاشوروف أو لتعويضه.

The author's allegations that Mr. Ashurov was subjected to torture and beatings to the point that he confessed guilt are groundless and confirmed by no evidence.
وإن ادعاءات صاحب البلاغ بأن السيد عاشوروف قد تعرض للتعذيب والضرب إلى درجة اضطر فيها إلى الاعتراف بالجُرم لا أساس لها من الصحة ولا توجد أية أدلة تؤكدها.

Thus, on 6 May 2002, Mr. Ashurov, in the presence of his lawyer, confessed guilt and provided a detailed description of his involvement in various crimes.
وعليه، في 6 أيار/مايو 2002 اعترف السيد عاشوروف بحضور محاميه بجُرمه وقدم وصفاً مفصلاً لتورطه في جرائم مختلفة.

The State party adds that Mr. Ashurov's criminal case file was examined under the supervisory proceedings and it was established that the criminal proceedings against him had been conducted in compliance with the national laws.
وتضيف الدولة الطرف أن ملف القضية الجنائية الخاص بالسيد عاشوروف قد خضع للدراسة في إطار الإجراءات الإشرافية وثبت أن إجراءات الدعوى الجنائية ضده قد تمت وفقاً للقوانين الوطنية.

Having concluded its consideration of communication No. 1348/2005, submitted to the Human Rights Committee on behalf of Olimzhon Ashurov under the Optional Protocol to the International Covenant on Civil and Political Rights,
وقد فرغت من نظرها في البلاغ رقم 1348/2005 المقدم بالنيابة عن السيد أوليمسون عاشوروف إلى اللجنة المعنية بحقوق الإنسان بموجب البروتوكول الاختياري الملحق بالعهد الدولي الخاص بالحقوق المدنية والسياسية،

Ashurov and both of his counsel repeatedly requested the court to allow them to study all case file materials, with the help of an interpreter.
وطلب عاشوروف ومحامياه تكراراً إلى المحكمة أن تأذن لهم بالاطلاع على جميع المستندات المرفقة بملف القضية مع الاستعانة بمترجم شفوي.

He asked leading questions to prosecution witnesses, corrected and completed their answers and instructed the court's secretary to record only those testimonies establishing Ashurov's guilt.
ووجه لشهود الإثبات أسئلة استدراجية وصوَّب أجوبتهم وتممّها، وأوعز إلى كاتب المحكمة بأن يكتفي بتسجيل تلك الشهادات التي تثبت أن عاشوروف مذنب.

The court ignored the defence's documentary evidence and testimony of defence witnesses and based its judgement on Ashurov's coerced confession.
وتجاهلت المحكمة الأدلة المستندية المقدمة من الدفاع كما تجاهلت الشهادات التي أدلى بها شهود النفي، واستندت في حكمها إلى الاعتراف الذي انتُزع من عاشوروف تحت الإكراه.
