ويستند عدم مشروعية المستوطنات الإسرائيلية في الأرض الفلسطينية المحتلة إلى المادة 49 من اتفاقية جنيف الرابعة، التي تنص على أنه " لا يجوز لدولة الاحتلال أن ترحِّل أو تنقل جزءا من سكانها المدنيين إلى الأراضي التي تحتلها " .
