Article 35. Acceptance of tender and entry into force of procurement contract
المادة ٣٥ - قبول العطاء ونفاذ عقد الاشتراء

This exception to the general rule requiring the award of the procurement contract to the winning bidder as determined at the end of the auction is included, in particular, to prevent dumping.
وهذا الاستثناء للقاعدة العامة التي تقتضي إرساء عقد الاشتراء على مقدِّم العرض الفائز كما يتحدّد في نهاية المناقصة يُدرَج بوجه خاص لمنع الإغراق.

(iii) failure to provide a required security for the performance of the contract after the tender has been accepted or to comply with any other condition precedent to signing the procurement contract specified in the solicitation documents.
' ٣ ' التخلف عن تقديم ضمان لازم لتنفيذ العقد بعد قبول العطاء أو عن الوفاء بأي شرط آخر سابق للتوقيع على عقد الاشتراء يكون منصوصا عليه في وثائق التماس العطاءات.

(e) Whether the award of procurement contracts under the framework agreement will be to the lowest priced or the most advantageous submission;
(ﻫ) ما إذا كان عقد الاشتراء بمقتضى الاتفاق الإطاري سوف يُرسى على أدنى العروض المقيَّمة سعرا أو على أكثر العروض فائدة؛

(1) In tendering proceedings, acceptance of the tender and entry into force of the procurement contract shall be carried out in accordance with article 35.
