Draft article 49 evaluates the proportionality of a countermeasure by accounting for “the degree of gravity of the internationally wrongful act and the effects thereof on the injured State”.

While fully sharing responsibility for the presence, in that article, of a part of the reference to " the effects thereof on the injured State " , we feel that the Commission should give more thought to that sentence and possibly cross it out.

To speak of the " effects of the breach on the injured State " may be relatively appropriate (despite the noted emphasis on one factor to the detriment of others) in the case of most delicts.

وباعتبار أن اتخاذ التدابير المضادة يكون فقط ضد الدولة المسؤولة، فإن استعمال عبارة " آثار الفعل غير المشروع دوليا على الدولة المضرورة " يكون أفضل من عبارة " الحقوق المعنية " .

The words " the rights in question " should be replaced by " the effects of the internationally wrongful act on the injured State " ; otherwise it has to be explained more clearly what rights are envisaged. (Republic of Korea; see also United States)
