44. In the preceding chapters, the Special Rapporteur has sought to draw the Council's attention to the basic characteristic common to all manifestations of religious defamation and all forms of religious phobia and discrimination, namely incitement to racial and religious hatred.

Although the international human rights instruments as well as regional instruments and national jurisprudence clearly establish that incitement to racial and religious hatred can be proscribed and sanctioned, the interpretation and implementation of the law has been highly uneven and problematic.
34- لئن نصت صكوك حقوق الإنسان الدولية ومعها الصكوك الإقليمية والفقه الوطني بوضوح على أن التحريض على الكراهية العرقية والدينية يمكن حظره والمعاقبة عليه، فإن تفسير القانون وتنفيذه قد ظلا متفاوتين وموضع جدل.

Furthermore, he invited the Council to encourage member States to wage a systematic campaign against incitement to racial and religious hatred by maintaining a careful balance between the defence of freedom of expression and respect for the freedom of religion and by acknowledging and respecting the complementarity among all the freedoms contained in the International Covenant on Civil and Political Rights.

In September 2006, pursuant to Human Rights Council decision 1/107 entitled " Incitement to racial and religious hatred and the promotion of tolerance " , the Special Rapporteur and the Special Rapporteur on freedom of religion or belief submitted a joint report on incitement to racial or religious hatred to the Council at its second session.
35- شكلت مسألة التحريض على الكراهية العرقية أو الدينية موضوع تقرير مشترك قدمه المقرر الخاص والمقررة الخاصة المعنية بحرية الدين أو المعتقد إلى مجلس حقوق الإنسان في دورته الثانية في أيلول/سبتمبر 2006، طبقاً لمقرر المجلس 1/107 المعنون " التحريض على الكراهية العرقية والدينية وتعزيز التسامح " .

23. In 2006, the High Commissioner for Human Rights submitted a report to the Human Rights Council on incitement to racial and religious hatred and the promotion of tolerance which outlines in detail the international legal framework with regard to incitement to religious hatred and violence (A/HRC/2/6).
23- في عام 2006، قدمت المفوضة السامية لحقوق الإنسان تقريراً إلى مجلس حقوق الإنسان بشأن التحريض على الكراهية العرقية والدينية وتعزيز التسامح، وتناول التقرير بالتفصيل الإطار القانوني الدولي فيما يتعلق بالتحريض على الكراهية الدينية والعنف (A/HRC/2/6).

In his view, while defamation of religions is a sociological concept, incitement to racial and religious hatred is a legal concept that can be dealt with under international instruments; in the framework of human rights, incitement to racial and religious hatred is prohibited by ICCPR, ICERD and the Durban Declaration and Programme of Action, and by many national constitutions.

In this regard, the Meeting noted with appreciation the OIC Group in Geneva's tireless efforts to remain constructively engaged with the process to ensure its success, as well as to effectively highlight the issues of concern to the OIC in an objective manner, such as the Occupied Palestinian Territory, incitement to racial and religious hatred and the importance of respect, tolerance and dialogue etc.
