34. Article 12, which dealt with the case of a child born after the succession of States to parents whose nationality, following the succession, had not been determined, provided that the child had the right to the nationality of the State concerned on whose territory that child was born.

As for the diplomatic protection of corporations and stockholders, it was unclear whether States could exercise diplomatic protection on behalf of a company registered or set up in their territory irrespective of the nationality of the members, or whether the majority of members had to have the nationality of the State concerned.

13. According to article 12, “a child of a person concerned, born after the date of the succession of States, who has not acquired any nationality, has the right to the nationality of the State concerned on whose territory that child was born”.
١٣ - وأضاف أنه وفقا للمادة ١٢ " للطفل الذي ولد لشخص معني بعد تاريخ خلافة الدول ولم يكتسب أي جنسية الحق في الحصول على جنسية الدولة المعنية التي ولد في إقليمها " .

" Every person possessing rights of citizenship (pertinenza) in territory which formed part of the territories of the former Austro-Hungarian Monarchy shall obtain ipso facto to the exclusion of Austrian nationality the nationality of the State exercising sovereignty over such territory. "

The acquisition of the nationality of each of the successor States other than Austria was contemplated in article 70 of the Treaty of Saint-Germain-en-Laye, according to which a person acquired the nationality of the State exercising sovereignty over the territory in which he or she possessed citizenship rights.These were rather cases of separation.
