In this connection, the State party notes that the provisions of its national legislation concerning the entry and stay of aliens in Morocco and irregular migration guarantees the right of aliens to access to a lawyer, an interpreter and a doctor, to communicate with their consulate or a person of their choice and to appeal a decision to escort them to the border within 48 hours of being notified of the decision.
وتذكّر الدولة الطرف في هذا الصدد أن أحكام التشريع الوطني المتعلق بدخول الأجانب إلى المغرب وإقامتهم فيه وبخصوص المهاجرين غير الشرعيين يكفل حق الأجنبي في الحصول على خدمات محامٍ ومترجم فوري وطبيب، وفي الاتصال بقنصلية بلده أو بأي شخص يريد الاتصال به، فضلاً عن الحق في إمكانية تقديم طعن خلال 48 ساعة من إشعاره بقرار ترحيله.

(b) The circulars of the National Commissioner of Police prescribing, inter alia, earlier access by family to detainees, mandatory medical examination of all persons placed in a detention cell, and access to a lawyer and an interpreter without delay;

3.4 The author submits that he did not have access to any lawyer for 72 hours and to a lawyer of his choice for more than two months; he was deprived of the right to remain silent; he was imposed an ex officio lawyer who was taking part in the proceedings only pro forma and he was not explained his rights to defence after his arrest on 24 December 1999.
3-4 ويؤكد صاحب البلاغ أنه حُرم لمدة 72 ساعة من فرصة الاجتماع مع محامٍ وحرم من الحصول على خدمات محامٍ من اختياره لمدة تجاوزت الشهرين؛ وحُرم من الحق في التزام الصمت؛ وفُرض عليه محامٍ معين، وأن مشاركة هذا المحامي في الإجراءات كانت مجرد مشاركة شكلية، وأنه لم يُطلع على حقوقه في الدفاع بعد توقيفه في 24 كانون الأول/ ديسمبر 1999.

ويود المقرر الخاص أن يُذكِّر بأنه " ينبغي للأحكام القانونية أن تكفل منح المحتجزين إمكانية الحصول على خدمات محامٍ في غضون 24 ساعة من عملية الاحتجاز.

Although it was unreasonable to expect every individual to know his or her rights as they were set out in the Covenant, it was important that they could take legal action relatively easily, and that they were entitled to legal counsel.
