It extends the competence of the Human Rights Committee to cover communications concerning its provisions (art. 5), unless States make a contrary statement on ratification or accession (article 5 of the second Optional Protocol to the International Covenant on Civil and Political Rights:

At the other end, national legislation may reflect only mandatory elements of the Convention, or even contain specific exceptions to Convention requirements, such as when a State party submits a reservation or declaration upon ratification or accession.

18. The Secretary-General notes that at least 14 out of 46 declarations made upon ratification or accession (7 out of 28 declarations made after the entry into force of the Convention) seem not to be in conformity with the provisions of article 310 or to be supported by any other provision of the Convention nor by any rule of general international law.
١٨ - ويلاحظ اﻷمين العام أن هناك على اﻷقل ١٤ إعلانا من بين ٤٦ إعلانا صدرت عند التصديق أو الانضمام )منها ٧ إعلانات من بين ٢٨ إعلانا صدرت بعد نفاذ الاتفاقية(، تبدو غير متفقة مــع أحكــام المادة ٣١٠ أو لا تستند إلى أي حكم من أحكام الاتفاقية ولا إلى أي قاعدة من قواعد القانون الدولي العام.

Article 28 of the Convention provides that the Secretary-General shall receive and circulate to all States the text of reservations made by States at the time of ratification or accession.
تنص المادة 28 من الاتفاقية على أن الأمين العام يتلقى نص التحفظات التي تبديها الدول عند التصديق أو الانضمام ويقوم بتعميمها على جميع الدول.

" 1. A State Party may at the time of ratification or at any time afterwards declare that it recognizes the competence of the Committee to receive and consider communications from or on behalf of individuals subject to its jurisdiction who claim to be victims of a violation of the provisions of [this instrument].
" 1- يجوز لكل دولة، عند التصديق أو بعده، أن تعلن اعترافها باختصاص اللجنة بتلقي وبحث البلاغات المقدمة من الأفراد الذين يخضعون لولايتها أو المقدمة نيابة عن هؤلاء الأفراد الذين يزعمون أنهم ضحايا لانتهاك أحكام [هذا الصك].

1. The State Party may, at the time of ratification or thereafter, declare that it recognizes the competence of the Committee to receive and consider communications from or on behalf of individuals subject to its jurisdiction who claim to be victims of a violation of the provisions of [this instrument].
1- يجوز لكل دولة طرف، عند التصديق أو بعده، أن تعلن اعترافها بأن للَّجنة اختصاص تلقي البلاغات المقدمة من الأفراد الذين يخضعون لولايتها أو المقدمة نيابة عن هؤلاء الأفراد الذين يزعمون أنهم ضحايا لانتهاك أحكام ]هذا الصك [والتحقيق في تلك البلاغات.

The Optional Protocol to the Convention on the Elimination of All Forms of Discrimination against Women, the Optional Protocol to the Convention on the Rights of Persons with Disabilities and the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment allow a State to declare on ratification or accession that it does not recognize the competence of the Committee to carry out such inquiries.
وبموجب البروتوكول الاختياري لاتفاقية القضاء على جميع أشكال التمييز ضد المرأة، والبروتوكول الاختياري لاتفاقية حقوق الأشخاص ذوي الإعاقة، واتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، يُسمح للدولة بأن تعلن عند التصديق أو الانضمام بأنها لا تعترف باختصاص اللجنة لإجراء تحريات من ذلك القبيل.
