Asked about the signature on the interrogation report, the lawyer declared that it was similar to hers, but maintained that Mr. Gunan had never testified about Chechnya in her presence.

A violation of this provision was also found in communication No. 1545/2007 (Gunan v. Kyrgyzstan).

It recalls that in 1999, Mr. Gunan was charged for serious crimes, including murder; terrorism in an organized group; participation in a criminal association; and, inter alia, the unlawful acquisition, possession and transmittal of firearms, ammunition, explosives and explosive devices.
وأشارت إلى أن السيد غونان اتهم في عام 1999 بارتكاب جرائم خطيرة من بينها القتل؛ والإرهاب من خلال جماعة منظمة؛ والمشاركة في عصابة إجرامية؛ وأمور من بينها اقتناء أسلحة نارية وذخيرة ومتفجرات وأجهزة متفجرة وحيازتها ونقلها على نحو غير مشروع.

Accordingly, it concludes that the facts before it reveal a violation of Mr. Gunan's rights under article 14, paragraph 3(b) and (d), of the Covenant.
ووفقاً لذلك، تستنتج أن الوقائع المعروضة أمامها تشكل انتهاكاً لحقوق السيد غونان كما تنصّ على ذلك الفقرة 3(ب) و(د) من المادة 14 من العهد.

173. In case No. 1545/2007 (Gunan v. Kyrgyzstan), the Committee held that, from the uncontested information before it, it transpired that the evaluation of evidence against the author by national courts reflected their failure to comply with the guarantees of a fair trial under article 14, paragraph 3 (b), (d) and (g).
173- وفي القضية رقم 1545/2007 (غونان ضد قيرغيزستان)، استخلصت اللجنة من المعلومات المعروضة عليها غير المطعون فيها أن تقييم الأدلة الموجهة ضد صاحب البلاغ من قبل المحاكم الوطنية يظهر عدم امتثالها للضمانات المتعلقة بإجراء محاكمة عادلة بموجب الفقرات 3(ب) و3(د) و3(ز) من المادة 14 من العهد.

179. Violations of this provision were also found in cases No. 1304/2004 (Khoroshenko v. Russian Federation), No. 1412/2005 (Butovenko v. Ukraine) and No. 1545/2007 (Gunan v. Kyrgyzstan).
179- وقد استنتجت اللجنة أيضاً وقوع انتهاكات لهذه الأحكام في القضايا رقم 1304/2004 (خوروشينكو ضد الاتحاد الروسي)، ورقم 1412/2005 (بوتوفينكو ضد أوكرانيا)، ورقم 1545/2007 (غونان ضد قيرغيزستان).

Accordingly, it concludes that the facts before it reveal a violation of Mr. Gunan's rights under article 14, paragraph 3 (b) and (d), of the Covenant.
ووفقاً لذلك، تستنتج اللجنة أن الوقائع المعروضة عليها تشكل انتهاكاً لحقوق السيد غونان بموجب الفقرة 3(ب) و(د) من المادة 14 من العهد.

In these circumstances, and in the absence of any observations on the author's specific claims by the State party, the Committee concludes that the facts before it disclose a violation of Mr. Gunan's rights under articles 7 and 14, paragraph 3 (g), of the Covenant.
وفي ظل هذه الظروف، ونظراً لعدم وجود أي ملاحظات من الدولة الطرف على ادعاءات صاحب البلاغ المحددة، تخلص اللجنة إلى أن الوقائع المعروضة أمامها تشير إلى انتهاك حقوق السيد غونان كما تنصّ على ذلك المادة 7 والفقرة 3(ز) من المادة 14 من العهد().

A similar conclusion was reached in case No. 1545/2007 (Gunan v. Kyrgyzstan), where the Committee decided that, in the light of its findings of a violation of article 14, the author was also a victim of a violation of his rights under article 6, paragraph 2, read in conjunction with article 14.
وخلصت اللجنة إلى استنتاج مماثل في القضية رقم 1545/2007 (غونان ضد قيرغيزستان)، حيث قررت اللجنة، في ضوء إثباتها لانتهاك المادة 14، أن صاحب البلاغ ضحية أيضاً لانتهاك حقوقه بموجب الفقرة 2 من المادة 6 مقروءة بالاقتران مع المادة 14.

Violations of both articles 7 and 14, paragraph 3 (g), were found in other cases, such as No. 1412/2005 (Butovenko v. Ukraine), No. 1535/2006 (Shchetka v. Ukraine) and No. 1545/2007 (Gunan v. Kyrgyzstan).
وقد استنتجت اللجنة أيضاً وجود انتهاكات للمادة 7 والفقرة 3(ز) من المادة 14 من العهد في قضايا أخرى، مثل القضية رقم 1412/2005 (بوتوفينكو ضد أوكرانيا)، ورقم 1535/2006 (شيتكا ضد أوكرانيا) ورقم 1545/2007 (غونان ضد قيرغسزتان).

A similar request was made in cases No. 1412/2005 (Butovenko v. Ukraine), No. 1535/2006 (Shchetka v. Ukraine), No. 1545/2007 (Gunan v. Kyrgyzstan) and No. 1813/2008 (Akwanga v. Cameroon), in which various violations of articles 7 and 14, inter alia, were found.
