Following the view expressed by the regional human rights courts referred to above, the Special Rapporteur of the Commission on Human Rights on the question of torture and other cruel, inhuman or degrading treatment or punishment is of the view that prompt judicial intervention serves as a guarantee that there will be no breach of the non-derogable right not to be subjected to torture or other forms of ill-treatment.
