Unless the Committee considers a communication inadmissible without reference to the State party concerned, the Committee shall, as soon as possible after the receipt of a communication, transmit it confidentially to the State party concerned and request that the State party provide written observations and comments.

The opening phrase of article 6.1 (“Unless the Committee considers a communication inadmissible without reference to the State party concerned ...”) has equivalents in existing procedures.40 These articles, however, subject the reference of a communication to a State party to situations where prima facie admissibility criteria listed in the preceding article or paragraph41 are absent.
