In order to fulfil the requirement that victims of torture during the dictatorship receive compensation, the Committee recommends that:
وتلبيةً لمطلب حصول من كانوا ضحايا للتعذيب أثناء فترة الحكم الاستبدادي على التعويض، توصي اللجنة بما يلي:

The families of individuals who had been victims of enforced disappearance during the dictatorship had requested specific action by the State to resolve issues such as inheritance and parentage in cases of missing persons.
وقامت أسر الضحايا الذين اختفوا قسراً في فترة الحكم الاستبدادي بمطالبة الدولة باتخاذ تدابير ملموسة للتمكّن بشكل خاص من تسوية قضايا الخلافة والنسب المتعلقة بالأشخاص المفقودين.

153. The Committee reiterates its concern that Act 23,521 (Law of Due Obedience) and Act 23,492 (Law of Punto Final) deny effective remedy to victims of human rights violations, in violation of article 2, paragraphs 2 and 3, and article 9, paragraph 5, of the Covenant.
١٥٣ - وتكــرر اللجنــة اﻹعـــراب عـن قلقهـا ﻷن القانون ٢٣ - ٥٢١ )قانون الطاعـة الواجبة( والقانون ٢٣ - ٤٩٢ )قانون الحد الفاصل لطي صفحة الماضي( يحرمان ضحايا انتهاكات حقوق الانسان فـي فترة الحكم الاستبدادي من وسائل الانتصاف الفعالة، وهذا انتهاك للفقرتين ٢ و ٣ من المـــادة ٢، والفقرة ٥ مـــن المــادة ٩ من العهد.

The Committee also urges the State party to repeal the provision contained in Act No. 19.992 under which information on the practice of torture during the dictatorship is to remain classified for 50 years.
كما تحث اللجنة الدولة الطرف على إلغاء الحكم الوارد في القانون رقم 19992 والقاضي بحفظ المعلومات المتعلقة بممارسة التعذيب أثناء فترة الحكم الاستبدادي لمدة 50 سنة.

It noted efforts to foster historical memory and called for further efforts to identify and exhume victims' remains and to prosecute those responsible for crimes committed during the dictatorship.
ولاحظت كوبا الجهود المبذولة في سبيل تدعيم الذاكرة التاريخية ودعت إلى بذل المزيد من الجهود لتحديد هوية الضحايا واستخراج رفاتهم ومقاضاة المسؤولين عن الجرائم المُرتكَبة خلال فترة الحكم الاستبدادي.

The Committee has learned of recent Supreme Court decisions that appear to take the existence of that decreelaw into account, particularly in reducing the applicable penalties for serious crimes committed during the dictatorship (art. 2).
ولقد علمت اللجنة بقرارات صادرة عن المحكمة العليا مؤخراً يبدو أنها تأخذ مرسوم القانون بعين الاعتبار، لا سيما لتخفيض العقوبات المنطبقة على جرائم خطيرة مرتكبة أثناء فترة الحكم الاستبدادي (المادة 2).

6. The Committee also welcomes the efforts made to date by the State party to establish the truth and secure reparation and access to justice in relation to the serious human rights violations committed in the country during the dictatorship.
6- وترحب اللجنة أيضاً بما بذلته الدولة الطرف من جهود حتى الآن لكشف الحقيقة وضمان الجبر والوصول إلى العدالة فيما يتصل بالانتهاكات الخطيرة لحقوق الإنسان التي ارتكبت في البلد خلال فترة الحكم الاستبدادي.

19. The Committee is concerned at the continuing impunity of those who perpetrated the crime of torture under the dictatorship and at the fact that suitable measures have not been taken to prosecute and sentence them (arts. 2 and 12).
19- تعرب اللجنة عن قلقها إزاء استمرار إفلات مرتكبي جريمة التعذيب أثناء فترة الحكم الاستبدادي من العقاب وإزاء عدم اتخاذ تدابير مناسبة لملاحقتهم قضائياً وتوقيع عقوبات مناسبة بحقهم (المادتان 2 و12).

25. The Committee takes note of the information provided to it concerning the compensation paid by the National Commission on Political Prisoners and Torture to persons recognized as having been victims of torture during the dictatorship.
25- تحيط اللجنة علماً بما وردها من معلومات بخصوص التعويضات التي دفعتها اللجنة الوطنية المعنية بالسجناء السياسيين والتعذيب إلى الأشخاص الذي اعتُرف بأنهم كانوا ضحايا للتعذيب أثناء فترة الحكم الاستبدادي.

(a) Effective action is taken to publicize the mandate and work of the Commission or the body to be created for the same purpose so that everybody who was a victim of torture during the dictatorship will be aware of its existence, particularly those who are in remote or underprivileged areas or are not in the country.
(أ) اتخاذ إجراءات فعالة للتعريف بولاية وعمل اللجنة أو الهيئة التي ستُنشأ للغرض ذاته بحيث يكون كل من كان ضحية للتعذيب أثناء فترة الحكم الاستبدادي واعياً بوجودها، لا سيما الضحايا المقيمون بالمناطق النائية أو المحرومة أو خارج البلد.
