2 - يعتبر فعلا صادرا عن الدولة الجديدة بمقتضى القانون الدولي تصرف أي حركة تمردية أو غير تمردية تنجح في إقامة دولة جديدة في جزء من أراضي دولة كانت موجودة قبل قيام الحركة أو في أراض تخضع لإدارتها.

We would note, however, that draft article 11 applies the converse rule to article 8: “The conduct of a person or a group of persons not acting on behalf of the State shall not be considered as an act of the State under international law.” This provision adds nothing to the draft.
