In promoting such a relationship, it is worth recalling the provisions of Article 96 regarding the possibility, open to both the General Assembly and the Council, to request advisory opinions from the Court on any legal question.
وعند تعزيز هذه العلاقة تجدر اﻹشارة إلى أحكام المادة ٩٦ بشأن اﻹمكانية المتاحة لكل من الجمعية العامة ومجلس اﻷمن في أن تطلب إلى محكمة العدل الدولية إصدار فتوى في أية مسألة قانونية.

Article 96 of the Charter of the United Nations provides that the General Assembly or the Security Council may request the Court to give an advisory opinion on any legal question.
فالمادة ٩٦ من ميثاق اﻷمم المتحدة تنص على أنه لكل من الجمعية العامة ومجلس اﻷمن أن يطلب إلى محكمة العدل الدولية افتاءه في أية مسألة قانونية.

Paragraph 1 of Article 96 of the Charter provides that " The General Assembly or the Security Council may request the International Court of Justice to give an advisory opinion on any legal question " .
وتنص الفقرة الأولى من المادة 96 من الميثاق على أنه " لأي من الجمعية العامة ومجلس الأمن أن يطلب إلى محكمة العدل الدولية إفتاء في أية مسألة قانونية " .

Article 65, paragraph 1, of the Statute of the International Court of Justice stipulates that " [t]he Court may give an advisory opinion on any legal question at the request of whatever body may be authorized by or in accordance with the Charter of the United Nations to make such a request " .
وتنص الفقرة 1 من المادة 65 من النظام الأساسي لمحكمة العدل الدولية على أنه " للمحكمة أن تفتي في أية مسألة قانونية بناء على طلب أية هيئة رخص لها ميثاق الأمم المتحدة باستفتائها، أو حصل الترخيص لها بذلك طبقا لأحكام الميثاق المذكور " .

The competence of the Court in this regard is based on Article 65, paragraph 1, of its Statute, according to which the Court " may give an advisory opinion on any legal question at the request of whatever body may be authorized by or in accordance with the Charter of the United Nations to make such a request " .
ويستند اختصاص المحكمة في هذا الشأن إلى الفقرة 1 من المادة 65 من نظامها الأساسي، التي تنص على أنه يجوز للمحكمة " أن تفتي في أية مسألة قانونية بناء على طلب أية هيئة رخص لها ميثاق الأمم المتحدة باستفتائها " .

In the present instance, the Court notes that the General Assembly, which seeks the advisory opinion, is authorized to do so by Article 96, paragraph 1, of the Charter, which provides: " The General Assembly or the Security Council may request the International Court of Justice to give an advisory opinion on any legal question. "

Article 65 (1), in the only addition to the Chapter on Advisory Opinions included in the Statute of this Court, expressly recognizes that the Court has a discretion whether to reply to a request: " The Court may give an advisory opinion on any legal question . . . "

First of all, the Court's jurisdiction to deliver the present Advisory Opinion is, in my view, established beyond any doubt, on the basis of Article 65(1) of its Statute, whereby the Court " may give an advisory opinion on any legal question at the request of whatever body may be authorized by or in accordance with the Charter of the United Nations to make such a request " .
