The term the " lowest evaluated tender " was considered to be the least ambiguous and had been used in the 1994 text among other things to emphasize the importance of price in tendering proceedings.

90. It was noted that the draft article had been prepared on the basis of provisions previously presented to the Working Group, and were intended to be equivalent to those governing the award of the procurement contract, and relevant exceptions, in tendering proceedings.

As stated in the commentary to the definition of " tender security " in article 2, the Model Law refers to " tender security " as the commonly-used term in the relevant context, without implying that this type of security may be requested only in tendering proceedings.
وكما ذُكر في التعليق على تعريف " ضمانة العطاء " في المادة 2، فإنَّ القانون النموذجي يشير إلى " ضمانة العطاء " باعتبارها المصطلح الشائع الاستعمال في السياق ذي الصلة، دون أن يستلزم ذلك ضمناً أنَّ هذا النوع من الضمانات لا يمكن طلبه إلاّ في إجراءات المناقصة.

3. Paragraph (2) has been included to enable the procuring entity to deal with delays in tendering proceedings following requests for extensions of the tender validity period.
3- وأُدرجت الفقرة (2) لتمكين الجهة المشترية من معالجة حالات التأخّر في إجراءات المناقصة عقب تلقّي طلبات بشأن تمديد فترة صلاحية العطاءات.

It was normal practice for prices to be disclosed to all suppliers or contractors in the tendering proceedings at the opening of tenders, but " the basis for determining the price " was often an industrial secret, and he therefore believed that it should not have to be disclosed.

5. Some other items in article 38 (subparagraphs (b), (c) and (q)-(s)) concern in particular the manner in which qualifications of suppliers and contractors will be ascertained and the tenders will be examined and evaluated and the applicable criteria; their disclosure is required to achieve transparency and fairness in the tendering proceedings.
5- وتتعلق بعض البنود الواردة في المادة 38 (الفقرات الفرعية (ب) و(ج) و(ف)-(ق)) على وجه الخصوص بالطريقة التي يتمّ التأكّد بها من مؤهّلات المورِّدين والمقاولين والتي يتم بها أيضاً تمحيص العطاءات وتقييمها والمعايير الواجب تطبيقها في ذلك؛ ومن ثم فإنَّ الإفصاح عنها لازم لتحقيق الشفافية والإنصاف في إجراءات المناقصة.

At its tenth session, the Working Group requested the Secretariat to propose the appropriate location for the provisions on ALTs, taking into account that the issue should not be limited to tendering proceedings, and that risks of ALTs should be examined and addressed by the procuring entity at any stage of the procurement, including through qualification of suppliers (A/CN.9/615, para. 75).
