12. The Group agreed that contacts with the High Contracting Parties to the original Protocol II that have not yet become party to Amended Protocol II should continue, either conducted by the President-designate or by the High Contracting Parties to the Convention in accordance with the mandate.
12- واتفق الفريق على ضرورة مواصلة الاتصالات مع الأطراف المتعاقدة السامية في البروتوكول الثاني الأصلي التي لم تنضم بعد إلى البروتوكول الثاني المعدَّل، وفقاً للولاية، على أن يجريها الرئيس المعيّن أو الأطراف المتعاقدة السامية في الاتفاقية.

The Coordinator informed that the President-designate engaged with the remaining States that are party to the original Protocol II but which have not yet consented to be bound by Amended Protocol II, as well as with the States that are priority for the universalization of Amended Protocol II.

(c) One State proposed a `phased out'long term plan which still needs to be discussed in detail among the States parties to the original Protocol II. This concept meant that a gradual process would be important in order for States to consider this issue in a more comprehensive manner.
(ج) اقترحت دولة خطة " تدريجية " طويلة الأجل لا يزال يتعين مناقشتها بالتفصيل فيما بين الدول الأطراف في البروتوكول الثاني الأصلي. ويعني هذه المفهوم أن إحداث عملية تدريجية سيكون أمراً مفيداً للدول لكي تنظر في هذه المسألة بطريقة أشمل.

The Group had agreed that the High Contracting Parties to the amended Protocol, in accordance with the mandate of the Thirteenth Annual Conference, should continue their contacts with the Parties to the original Protocol II that had not yet become party to amended Protocol II, and underscored that any action with respect to the termination of the original Protocol should be taken with the consent of the parties to that Protocol.

(c) The High Contracting Parties to the Convention on Certain Conventional Weapons shall continue their contacts with the High Contracting Parties to the original Protocol II that have not yet become parties to amended Protocol II, to encourage them to accede to it and thus to facilitate the termination of the original Protocol II;
(ج) تواصل الأطراف المتعاقدة السامية في الاتفاقية اتصالاتها مع الأطراف المتعاقدة السامية في البروتوكول الثاني الأصلي والتي لم تنضم بعد إلى البروتوكول الثاني المعدل لتشجيعها على الانضمام إليه، وبذلك تيسر إنهاء العمل بالبروتوكول الثاني الأصلي؛

As the procedure recommended in paragraph 20 (c) -- of encouraging the Parties to the original Protocol II to accede to the amended one -- could take considerable time, one delegation had proposed that the High Contracting Parties to the Convention should declare a freeze on accessions to the original Protocol II.

Termination of the original Protocol II was not a priority for the Conference.
59- واستطرد قائلاً إن وفده يدعم المقترح الذي يقضي بتزامن تقديم التقارير بموجب البروتوكول الثاني المعدّل والبروتوكول الخامس كما يدعم التوصية التي تقدّم بها المنسق والقاضية بمواصلة الاتصالات مع الأطراف السامية المتعاقدة في البروتوكول الثاني الأصلي والتي لم تنضم بعد إلى البروتوكول الثاني المعدّل، وأضاف أن إنهاء العمل بالبروتوكول الثاني الأصلي ليس من أولويات المؤتمر.

Israel supported the Coordinator's recommendation to encourage the High Contracting Parties to the original Protocol II that had not yet become parties to amended Protocol II to accede to it, as well as the Coordinator's intention to insert in his report a reference to the requirement for consent of all Parties to the termination of the original Protocol II.
وقد دعمت إسرائيل التوصية التي تقدم بها المنسق والقاضية بتشجيع الأطراف السامية المتعاقدة في البروتوكول الثاني الأصلي والتي لم تنضم بعد إلى البروتوكول الثاني المعدّل، على الانضمام إليه، كما دعمت نية المنسق إدراج إشارة في تقريره إلى الشرط القاضي بموافقة جميع الأطراف على إنهاء العمل بالبروتوكول الثاني الأصلي.

Furthermore, paragraph 20 (c) of the draft recommendations would encourage the High Contracting Parties to the Convention that were Parties to the original Protocol II to accede to amended Protocol II before denouncing the instrument and thus avoid a situation in which a Party, on denunciation, was no longer bound by two or more protocols as required under article 4 of the Convention.
وأضاف أن الأمر ينطوي، في الفقرة الفرعية (ج) من الفقرة 20 من مشروع التوصيات، على تشجيع الأطراف المتعاقدة السامية في الاتفاقية التي هي أطراف في البروتوكول الثاني الأصلي على الانضمام إلى البروتوكول الثاني المعدل قبل الانسحاب من الصك، تفادياً لحالات لا يكون فيها طرف من الأطراف في الاتفاقية، بحكم انسحابه من البروتوكول، ملتزماً ببروتوكولين على الأقل، على نحو ما تقتضيه المادة 4 من الاتفاقية.

8. Finland as President-designate of Amended Protocol II approached in Geneva eleven High Contracting Parties that are party to original Protocol II and have not yet joined Amended Protocol II and followed-up with letters to two of these States.
8- وتواصلت فنلندا، في جنيف، بوصفها الرئيس المُعيَّن للاجتماع المتعلق بالبروتوكول الثاني المعدَّل، مع أحد عشر طرفاً متعاقداً سامياً في البروتوكول الثاني الأصلي ولم تصبح بعد أطرافاً في البروتوكول الثاني المعدَّل، ووجهت رسائل إلى اثنتين من هذه الدول.
