وخلصت اللجنة المعنية بحقوق الإنسان، في تعليقها العام رقم 8 بشأن حق الفرد في الحرية وفي الأمان على شخصه، إلى أن المصطلح يشمل جميع أنواع الحرمان من الحرية، سواءً في الحالات الجنائية أو في الحالات الأخرى، ومنها على سبيل المثال الأمراض العقلية والتشرد وإدمان المخدرات والأغراض التربوية ومراقبة الهجرة().

In its General Comment No. 8 (1982) on liberty and security of person, the Human Rights Committee pointed out (para. 1) that the protection afforded by article 9 (1) was applicable to all deprivations of liberty, whether in criminal cases or in other cases such as, for example, mental illness.
وأشارت اللجنة المعنية بحقوق الإنسان، في تعليقها العام رقم 8، إلى أن الحماية التي توفرها المادة 9 (أ) تنطبق على جميع حالات الحرمان من الحرية، سواء في الحالات الجنائية أو في الحالات الأخرى كالأمراض العقلية.
