١٤٨ - من دواعي قلق اللجنة أن عدم إدراج جميع الحقوق المضمونة في العهد في القانون الوطني ووجود قيود غير مسموح بها في هذا الصدد يؤثران على التنفيذ الكامل للعهد في موريشيوس، وعليه فإن النظام القانوني في موريشيوس لا يكفل توافر وسائل انتصاف فعالة في جميع حالات انتهاك الحقوق المكفولة في العهد.

The provisions of the Covenant relating to procedural safeguards may never be made subject to measures that would circumvent the protection of non-derogable rights.
ولا يجوز أن تكون الضمانات الإجرائية المنصوص عليها في العهد في أي وقت من الأوقات موضعا لتدابير تحول دون توفير الحماية اللازمة لهذه الحقوق.

The Committee urges that the State party incorporate the rights of the Covenant in its domestic legal order.

409. The Committee considered the state of implementation by Saint Vincent and the Grenadines of the economic, social and cultural rights contained in the Covenant at its 45th meeting on 28 November 1997 and adopted the following concluding observations.
٩٠٤- نظرت اللجنة في حالة تنفيذ سانت فنسنت وجزر غرينادين للحقوق الاقتصادية والاجتماعية والثقافية الواردة في العهد في جلستها الخامسة واﻷربعين المعقودة في ٨٢ تشرين الثاني/نوفمبر ٧٩٩١، واعتمدت الملاحظات الختامية التالية.

151. The Committee regrets that the report of the State party does not contain sufficiently updated information and detailed statistics that would enable it to fully assess whether and how the rights set out in the Covenant are being implemented in the State party.
151- وتعرب اللجنة عن أسفها لأن تقرير الدولة الطرف لا يتضمن معلومات مستكملة بالقدر الكافي وإحصاءات مفصلة تمكّن اللجنة من إجراء تقييم كامل لمدى إعمال الحقوق المنصوص عليها في العهد في الدولة الطرف.

The Committee recommends that all necessary steps be taken by the Government to give legal effects to the rights enshrined in the Covenant in the domestic legal order.
٩١- توصي اللجنة بأن تتخذ الحكومة كافة الخطوات اللازمة ﻹعطاء آثار قانونية للحقوق المنصوص عليها في العهد في النظام القانوني المحلي.

If any deliberately retrogressive measures are taken, the State party has the burden of proving that they have been introduced after the most careful consideration of all alternatives and that they are duly justified by reference to the totality of the rights provided for in the Covenant, in the context of the full use of the maximum available resources of the State party.
وإذا اتخذت أي تدابير تراجعية عمداً، يقع على كاهل الدولة الطرف عبء إثبات أن هذه التدابير استحدثت بعد النظر بعناية قصوى في جميع البدائل، وأن هناك ما يبررها حقاً بالرجوع إلى جميع الحقوق المنصوص عليها في العهد في سياق الاستخدام الكامل لأقصى الموارد المتاحة للدولة الطرف.

وتأسف اللجنة لغياب خبراء من الدولة الطرف ولكون المعلومات المقدمة لم تكن، في بعض الحالات، مفصلة بما فيه الكفاية لكي تجري اللجنة تقييماً أشمل لمستوى التمتع بالحقوق المنصوص عليها في العهد في الدولة الطرف.

20. Mr. ZAKHIA said that, pursuant to the Fourth Geneva Convention and in the virtually unanimous opinion of international bodies, an occupying Power bore full responsibility for protecting the human rights recognized in the Covenant in the territories it occupied.
٠٢- السيد زاخية قال إنه عملا بإتفاقية جنيف الرابعة وبالرأي الذي أجمعت عليه تقريبا الهيئات الدولية، تتحمل أية سلطة محتلة المسؤولية كاملة عن حماية حقوق اﻹنسان المعترف بها في العهد في اﻷراضي التي تحتلها.

The Committee appreciates the opportunity afforded to hold a dialogue with representatives of the State party and the answers to the questions raised by the Committee. The Committee regrets however, that the information provided was in some cases not sufficiently detailed to advance the Committee's assessment of the level of enjoyment of the rights provided for in the Covenant in the State party.

The Committee is concerned that the State party's Constitution affords protection to the rights contained in the Covenant in two distinct chapters, while the implementation of one of them (the fifth chapter) cannot be claimed directly in courts.
ويساور اللجنة القلق لأن دستور الدولة الطرف يمنح الحماية للحقوق الواردة في العهد في فصلين منفصلين، في حين أنه لا يمكن الاحتجاج مباشرة أمام المحاكم بتنفيذ أحدهما (الفصل الخامس).

١٣ - من دواعي قلق اللجنة أن عدم إدراج جميع الحقوق المضمونة في العهد في القانون الوطني وتقييد الحريات يؤثران على التنفيذ الكامل للعهد في موريشيوس، وعليه فإن النظام القانوني في موريشيوس لا يكفل توافر وسائل انتصاف فعالة في جميع حالات انتهاك الحقوق التي نص العهد على ضمانها.

The Committee noted that if expulsion procedures entail arrest, the safeguards of the Covenant relating to deprivation of liberty (articles 9 and 10) may also be applicable.
فقد لاحظت اللجنة المعنية بحقوق الإنسان أنه إذا كان إجراء الطرد يشمل التوقيف، فإن الضمانات المنصوص عليها في العهد في حالة الحرمان من الحرية (المادتان 9() و10()) يمكن أن تسري أيضاً().
