٣٠٧ - وأعرب عن القلق إزاء حق كل إنسان في اﻷمن على شخصه، ولا سيما فيما يتعلق بالسكان اﻷصليين أو المهاجرين بصورة غير قانونية.

75. The Committee recommends further action to protect the right of everyone to enjoy, without discrimination, the civil and political rights listed in article 5 of the Convention, notably the rights to equal treatment within the criminal justice system and to security of person.
٧٥ - وتوصي اللجنة باتخاذ مزيد من التدابير لحماية حق كل إنسان في التمتع، دون تمييز، بالحقوق المدنية والسياسية المدرجة في المادة ٥ من الاتفاقية، ولا سيما الحق في المساواة في المعاملة في إطار نظام العدالة الجنائية والحق في اﻷمن على شخصه.

400. The Committee recommends that the enjoyment by everyone without discrimination of the rights listed in article 5 of the Convention be ensured, in particular the right to security of person and protection against violence or bodily harm (art. 5 (b)).

States parties to that Convention undertake to prohibit and to eliminate discrimination in the enjoyment of a number of rights, including the right to security of person and protection by the State against violence or bodily harm, whether inflicted by government officials or by any individual group or institution (art. 5 (b)).

كما أن الافتقار إلى معلومات عن حالة اللاجئين الذين يعيشون في بوروندي يدعو إلى اﻷسف، ولا سيما منذ ورود تقارير تفيد أن حقوقهم في اﻷمن على أشخاصهم وفي حماية الدولة لهم من أي عنف أو أذى بدني يصدر سواء من موظفين رسميين أو عن أية جماعة أو مؤسسة، هي، بموجب المادة ٥ )ب( من الاتفاقية ليست مكفولة دائما.

518. It is also noted with appreciation that a number of the rights enumerated in article 5 of the Convention, namely the right to equal treatment before tribunals, to security of person, to vote and to stand for elections, to freedom of movement, thought, conscience and religion, and to peaceful assembly and association, as well as certain economic and social rights, are included in the Constitutional Act.
٥١٨ - ويلاحظ أيضا مع التقدير أن القانون الدستوري الانتقالي يضم عددا من الحقوق المذكورة في المادة ٥ من الاتفاقية، وهي حق كل إنسان في المساواة في المعاملة أمام المحاكم، والحق في اﻷمن على شخصه وفي الاقتراع والترشيح وفي حرية التنقل والفكر والعقيدة والدين والاجتماع السلمي وفي تكوين الجمعيات السلمية، فضلا عن حقوق اقتصادية واجتماعية معينة.

549. It is noted with appreciation that the full and equal enjoyment by everyone of the rights enumerated in article 5 of the Convention, and in particular the right to security of person, to marriage, to property, to freedom of thought, conscience and religion, to housing, to health and social security, to education and to participate in cultural activities, is guaranteed and ensured in Mauritius.
٥٤٩ - ويلاحظ مع التقدير ضمان وكفالة تمتع كل إنسان بموريشيوس تمتعا تاما ومتساويا بالحقوق الواردة في المادة ٥ من الاتفاقية ولا سيما حق كل إنسان، في اﻷمن على شخصه وفي الزواج وفي التملك وفي حرية الفكر والمعتقد والديانة، وفي السكن، وفي الخدمات الصحية، وفي الضمان الاجتماعي، وفي التعليم، وفي المشاركة في اﻷنشطة الثقافية.

224. With regard to the right to equal treatment before the tribunals and the right to security of person and protection by the State against violence or bodily harm (article 5, paragraphs (a) and (b), of the Convention), concern is expressed at the reported cases of torture and other cruel or degrading treatment on the part of police and investigating officers.
٤٢٢- وفيما يخص الحق في معاملة على قدم المساواة أمام المحاكم وحق الفرد في اﻷمن على شخصه وفي حماية الدولة له من أي عنف أو أذى بدني )الفقرتان )أ( و)ب( من المادة ٥ من الاتفاقية( أُعرب عن القلق إزاء التقارير التي تشير إلى قيام رجال الشرطة والمحققون بأعمال التعذيب وغيرها من ضروب المعاملة القاسية أو المهينة.

5. The Committee urgently appeals to all authorities to guarantee, in conformity with Article 5, paragraph (b), of the Convention, to all persons under their jurisdiction, without distinction as to national or ethnic origin, the rights to security of person and protection against violence or bodily harm, and to take appropriate measures against individuals and institutions violating these rights.
٥ - وتناشد اللجنــة على وجــه الاستعجال جميــع السلطات أن تضمن، وفقا للفقـرة )ب( من المادة ٥ من الاتفاقية، لجميع اﻷشخاص الخاضعين لولايتها، دون تمييز بسبب اﻷصل القومي أو العرقي، الحق في اﻷمن على أنفسهم وفي الحماية من أي عنف أو أذى بدني، وأن تتخذ التدابير المناسبة ضد من ينتهك هذه الحقوق من اﻷفراد والمؤسسات.
