(i) The perilous distortion of or deviation from the rule of law that ensues from the implementation of emergency measures under ordinary legislation, without recourse to a formal declaration of a state of emergency, which was described by the Special Rapporteur in his seventh report to the Commission and to the Subcommission (E/CN.4/Sub.2/1994/23, paras. 39-41) as follows:

26. in his seventh report on MONUC (S/2001/373) dated 17 April 2001, the Secretary-General acknowledged the need to prepare for an eventual third phase of MONUC operations as the parties to the Lusaka Ceasefire Agreement carried out the tasks set out therein.

69. The more time that national authorities have to perform such checks, the more likely they are to identify listed individuals, and in its seventh report (S/2007/677, para. 92), the Team noted the importance in this respect of the Advance Passenger Information System.
