As a result of his work so far, the Special Rapporteur drew detailed conclusions in his report to the Commission in 1995 (E/CN.4/1995/56, paras. 61-66) concerning the factual situation, the causes of the violations which he determined to be widespread, and also the responsibility (both of the State and also of named individuals) for those violations.

Welcomes the report of the Special Rapporteur on the promotion and protection of the right to freedom of opinion and expression (E/CN.4/1996/39 and Add.1 and 2), and recalls his conclusion in his report to the Commission at its fifty-first session that freedom of expression is a fundamental right, the enjoyment of which illustrates in many ways the degree of enjoyment of all human rights enshrined in the International Bill of Human Rights;

The Special Rapporteur again reiterates the recommendations summarized in his report to the Commission at its fifty—first session (E/CN.4/1995/34, para. 926) and reminds Governments of how some of their responses to his communications could be focused to facilitate his work, as indicated in his report to the fifty—second session of the Commission (E/CN.4/1996/35, paras. 198-201).
