يجوز لكبير موظفي المشتريات، أن يقرر في عملية شراء بعينها أن اتباع الطرق الرسمية في طلب تقديم العروض لا يحقق مصلحة البرنامج الإنمائي على الوجه الأمثل، وذلك في الحالات التالية:

(a) The Registrar may, with the approval of the President, determine for a particular procurement action that using formal methods of solicitation is not in the best interest of the Tribunal:
(أ) يجوز للمسجل بموافقة الرئيس فيما يتعلق بعملية شراء بعينها أن يقرر أن اتباع الطرق الرسمية في طلب تقديم العروض لا يحقق مصلحة المحكمة على الوجه الأمثل، وذلك في الحالات التالية:

(أ) يجوز للمسجل، فيما يتعلق بعملية شراء بعينها أن يبت بأن اتباع الطرق الرسمية في طلب تقديم العروض لا يحقق مصلحة المحكمة على الوجه الأمثل، وذلك في الحالات التالية:

(d) Formal methods of solicitation, utilizing invitations to bid or requests for proposals on the basis of advertisement or direct solicitation of invited suppliers, or informal methods of solicitation, such as requests for quotations.
(د) اتباع الطرق الرسمية في طلب تقديم العروض باستخدام دعوات تقديم العروض، أو التماس تقديم الاقتراحات عن طريق الإعلان، أو تقديم الطلبات المباشرة إلى الموردين المدعوين؛ أو باستخدام الطرق غير الرسمية لطلب العروض، مثل طلبات التقدم بعروض الأسعار.

Such a provision for liquidated damages does not ensure delivery of services by the operational dates indicated in the request for proposals.
