6.2 In accordance with article 5, paragraph 2 (a), the Committee has established that the same matter has not been submitted for examination under another procedure of international investigation or settlement.

7.2 The Committee has ascertained, as required under article 5, paragraph 2(a), of the Optional Protocol, that the same matter is not being examined under another procedure of international investigation or settlement.

In other words, the subparagraph must be understood as meaning that the Committee " shall not consider any communication from an individual unless it has ascertained that the same matter is not being examined under another procedure of international investigation or settlement " .

The Committee also recalls that when the State party adhered to the Optional Protocol, it entered a reservation to article 5, paragraph 2 (a), specifying that the Committee " shall not have competence to consider a communication from an individual if the same matter is being examined or has already been considered under another procedure of international investigation or settlement " .
وتذكّر اللجنة أيضاً بأن الدولة الطرف، حينما انضمت إلى البروتوكول الاختياري، أبدت تحفظاً على الفقرة 2(أ) من المادة 5 منه مفاده أنه " ليس من اختصاص اللجنة النظر في بلاغ مقدم من فرد إذا كان نفس الموضوع قيد النظر أو نُظر فيه بالفعل في هيئة أخرى من هيئات التحقيق الدولي أو التسوية الدولية " .

The Committee also recalls that, upon its acceptance of the Optional Protocol, the State party entered a reservation to article 5, paragraph 2 (a), of the Protocol specifying that the Committee " shall not have competence to consider a communication from an individual if the same matter is being examined or has already been considered under another procedure of international investigation or settlement " .
وتشير اللجنة كذلك إلى أن الدولة الطرف قامت عند انضمامها إلى البروتوكول الاختياري، بإبداء تحفظ بشأن الفقرة 2(أ) من المادة 5 من البروتوكول الاختياري، موضحة أن اللجنة " لن تكون مختصة بالنظر في البلاغات المقدمة من الأشخاص إذا كانت المسألة نفسها خاضعة للبحث أو سبق بحثها في هيئة أخرى من هيئات التحقيق الدولي أو التسوية الدولية " .
