(iii) Failure to provide a required security for the performance of the contract after the tender has been accepted or to comply with any other condition precedent to signing the procurement contract specified in the solicitation documents.
' ٣ ' التخلف عن تقديم ضمان لازم لتنفيذ العقد بعد قبول العطاء أو عن الوفاء بأي شرط آخر سابق للتوقيع على عقد الاشتراء يكون منصوصا عليه في وثائق التماس العطاءات.

(f) The procuring entity shall specify in the solicitation documents any requirements with respect to the issuer and the nature, form, amount and other principal terms and conditions of the required tender security; any requirement that refers directly or indirectly to conduct by the supplier or contractor submitting the tender shall not relate to conduct other than:
)و( تحدد الجهة المشترية في وثائق التماس العطاءات أية اشتراطات بشأن المصدر وطبيعة ضمان العطاء المطلوب تقديمه وشكله وقيمته وسائر أحكامه وشروطه الرئيسية؛ وكل اشتراط يشير بصورة مباشرة أو غير مباشرة الى سلوك المورد أو المقاول المقدم للعطاء لا يجوز أن يكون متصلا بأي سلوك غير ما يلي:

(1) Tenders shall be opened at the time specified in the solicitation documents as the deadline for the submission of tenders, or at the deadline specified in any extension of the deadline, at the place and in accordance with the procedures specified in the solicitation documents.
)١( تفتح العطاءات في الوقت المحدد في وثائق التماس العطاءات كموعد نهائي لتقديم العطاءات، أو في الموعد النهائي المحدد في أي تمديد للموعد النهائي، وفي المكان المعين في وثائق التماس العطاءات ووفقا للاجراءات المحددة فيها.

A failure to obtain the approval within the time specified in the solicitation documents shall not extend the period of effectiveness of tenders specified in the solicitation documents pursuant to article 31 (1) or the period of effectiveness of tender securities that may be required pursuant to article 32 (1).
ولا يؤدي عدم الحصول على الموافقة خلال الفترة الزمنية المحددة في وثائق التماس العطاءات إلى تمديد الفترة التي يسري خلالها مفعول العطاءات والتي تحدد في وثائق التماس العطاءات عملا بالمادة ٣١ )١(، ولا الفترة التي يسري خلالها مفعول ضمانات العطاءات التي يمكن اشتراطها عملا بالمادة ٣٢ )١(.

ولا يؤدي عدم الحصول على الموافقة خلال الفترة الزمنية المحددة في وثائق التماس العطاءات إلى تمديد الفترة التي يسري خلالها مفعول العطاءات والتي تحدد في وثائق التماس العطاءات عملا بالمادة ٢٩ )١(، ولا الفترة التي يسري خلالها مفعول ضمانات العطاءات التي يمكن اشتراطها عملا بالمادة ٣٠ )١(.

(b) The procuring entity may regard a tender as responsive even if it contains minor deviations that do not materially alter or depart from the characteristics, terms, conditions and other requirements set forth in the solicitation documents or if it contains errors or oversights that are capable of being corrected without touching on the substance of the tender.
)ب( يجوز للجهة المشترية أن تعتبر العطاء إيجابيا حتى وإن احتــوى على انحرافــات ثانوية لا يترتب عليها تغيير أو انحراف جوهري عن الخصائص واﻷحكام والشروط وغيرها من الاشتراطات المنصوص عليها في وثائق التماس العطاءات أو احتوى على أخطاء أو جوانب سهو يمكن تصحيحها دون اﻹخلال بجوهر العطاء، وبقدر اﻹمكان، تقدر هذه الانحرافات كميا وتؤخذ في الحسبان على النحو المناسب في تقييم العطاءات والمقارنة بينها.
