183. The enforcement judges also indicated that the prison service frequently cites lack of budget as a justification for violations of the rights of detainees.

(b) Take steps to ensure that the Prison Department keeps reliable records of admissions and releases and informs the enforcement judges thereof in a timely manner;

Such transfers have been objected to by the judiciary (chiefly enforcement judges), however, on the grounds that prior authorization by the courts is required before a prisoner can be transferred from one prison to another.

(a) Enact reforms that establish an adequate legal basis for the duties currently performed by enforcement judges in relation to persons in pretrial detention, in particular in ensuring compliance with the maximum periods of pretrial detention.
(أ) إجراء إصلاحات تضع أساسا قانونيا مناسبا للمهام التي يقوم بها حاليا قضاة التنفيذ فيما يخص الأشخاص الذين هم رهن الاحتجاز السابق للمحاكمة، ولا سيما في ضمان الامتثال للفترات القصوى للاحتجاز السابق للمحاكمة.

60. The Act accordingly provides for the incorporation of an article 50 quater in the Federal Judiciary Organization Act stipulating that federal enforcement judges will deal with matters relating to the modification and length of sentences and the conduct of procedures for the granting of redress.
60- لذا، يتوخى إضافة مادة جديدة هي المادة 50(رابعاً) إلى القانون الأساسي للسلطة القضائية للاتحاد بغية تأكيد وجوب قيام قضاة التنفيذ الاتحاديين بالبت في تعديل العقوبات ومدتها وتبرير الإجراء المتعلق بالتعويض عن الأضرار.

181. As to pretrial detention, article 191 establishes that enforcement judges shall guarantee detainees' rights in relation to the place of detention (which may be in a prison but must be quite separate from the places where convicted prisoners are held) and their treatment (pretrial detention must not assume the characteristics of a prison sentence).
