3. In 2010, the General Assembly of the United Nations, by its resolution 65/22, recommended the use of the UNCITRAL Arbitration Rules in the settlement of disputes arising in the context of international commercial relations.

After discussion, the Commission agreed that it would not be desirable to include specific provisions on treaty-based arbitration in the UNCITRAL Arbitration Rules themselves and that any work on investor-State disputes which the Working Group might have to undertake in the future should not delay the completion of the revision of the UNCITRAL Arbitration Rules in their generic form.

The Commission expressed the hope that the Working Group would complete its work on the revision of the UNCITRAL Arbitration Rules in their generic form, so that the final review and adoption of the revised Rules would take place at the forty-second session of the Commission, in 2009.
315- وأعربت اللجنة عن أملها في أن ينجز الفريق العامل عمله بشأن تنقيح قواعد الأونسيترال للتحكيم في شكلها العام في وقت يتيح إجراء الاستعراض النهائي لتلك الصيغة المنقّحة واعتمادها في الدورة الثانية والأربعين للجنة، عام 2009.

"

Article 1(1) and 1(2) reflect the compromise struck specifically with respect to references to the UNCITRAL Arbitration Rules in future and existing treaties.

Questions were raised as to the binding effect legal standards on transparency might have on arbitration provisions referring to the UNCITRAL Arbitration Rules in existing investment treaties, in particular for those arbitration provisions that did not specify the applicable version of the Rules.
27- وطُرحت تساؤلات بشأن ما قد يكون للمعايير القانونية بشأن الشفافية من مفعول ملزم في أحكام التحكيم التي تشير إلى قواعد الأونسيترال للتحكيم في المعاهدات الاستثمارية القائمة، وخصوصاً أحكام التحكيم التي لم تُحدّد صيغة القواعد المنطبقة.

In that respect, the Working Group recalled its recent works on transparency in treaty-based investor-State arbitration, including the revision to the UNCITRAL Arbitration Rules in 2013 in relation to the application of the UNCITRAL Rules on Transparency in Treaty-based Investor-State Arbitration (the " Rules on Transparency " ).

4. Mr. Sorieul (Secretary of the Commission) said that since the adoption of the decision reproduced in section C, paragraph 1 of the addendum to the draft report (A/CN.9/XLIII/CRP.1/Add.5), it had been pointed out that it would be worth drawing attention to the value of the UNCITRAL Arbitration Rules in the context of activities for the promotion of the rule of law.

The Commission agreed that the time required should be taken for meeting the high standard of UNCITRAL, taking account of the international impact of the Rules, and expressed the hope that the Working Group would complete its work on the revision of the UNCITRAL Arbitration Rules in their generic form, so that the final review and adoption of the revised Rules would take place at the forty-third session of the Commission, in 2010.

290- وأُشير كذلك إلى أن اللجنة اتفقت بعد المناقشة أثناء تلك الدورة على عدم استحسان تضمين قواعد الأونسيترال للتحكيم ذاتها أحكاما خاصة بالتحكيم التعاهدي، وأنه لا ينبغي لأي عمل قد يتعين على الفريق العامل الاضطلاع به مستقبلا بشأن النـزاعات بين المستثمرين والدول أن يؤخّر الانتهاء من تنقيح قواعد الأونسيترال للتحكيم في شكلها العام.

The Commission noted that the Working Group had decided to proceed with its work on the revision of the UNCITRAL Arbitration Rules in their generic form and to seek guidance from the Commission on whether, after completion of its current work on the Rules, the Working Group should consider in further depth the specificity of treaty-based arbitration and, if so, which form that work should take (A/CN.9/646, para. 69).
