In support of limiting the application of the transparency rules to future investment treaties, it was said that States could not be put in a situation where they would have to reopen negotiations or issue declarations on interpretation of each of their existing investment treaties to indicate whether or not the rules on transparency would apply.
44- وتأييداً لقصر تطبيق قواعد الشفافية على معاهدات الاستثمار المقبلة، قيل إنَّ من غير الممكن وضع الدول في موقف يضطرها إلى إعادة فتح مفاوضات أو إصدار إعلانات بشأن تفسير كل معاهدة من معاهداتها الاستثمارية الحالية لبيان ما إذا كانت قواعد الشفافية تنطبق عليها أم لا.

The Commission may wish to consider including the same definition as a footnote to the UNCITRAL Arbitration Rules 2013, in order to facilitate the non-interference of the rules on transparency for users of the UNCITRAL Arbitration Rules 2013 in a purely commercial context.
