٢- للدولة المستقلة حديثا، لدى اصدارها إشعارا بالخلافة يثبت صفتها كطرف أو كدولة متعاقدة في معاهدة متعددة اﻷطراف بمقتضى المادة ٧١ أو المادة ٨١، أن تضع تحفﱡظا، إلا إذا كان من تلك التحفظات التي تمنع وضعها أحكام الفقرتين الفرعيتين )أ( أو )ج( من المادة ٩١ من اتفاقية فيينا لقانون المعاهدات.

In addition, with regard to guideline 4.2.1 (Status of the author of an established reservation), he questioned whether depositaries did, in practice, wait 12 months for a reservation to be established before they treated the author of the reservation as a contracting State to the treaty in question.
