Another witness, Mr. Mizrobov, testified that he was present on 5 May 2001 when Kurbanov was taken to the authorities.

The State party adds that verifications have been conducted with the officers who had arrested Mr. Kurbanov and had carried out the investigation of the criminal case, and no use of unlawful methods of investigation was revealed.

As to the conditions of the pretrial detention of Mr. Kurbanov, the State party explains that the latter was kept in accordance with the existing regulations, and was treated the same way as all other detainees.

In the light of all these considerations, and given the gravity of the crimes committed, the State party considers that there is no basis for the re-examination of Mr. Kurbanov's criminal case or for his compensation.

In the State party's view, the author's allegations about the use of illegal methods of interrogation including violence and torture against her son should be considered unsubstantiated, as neither during the investigation nor in court, were such allegations raised by Mr. Kurbanov.
وترى الدولة الطرف أن ما تدعيه صاحبة البلاغ من استخدام أساليب تحقيق غير شرعية ضد ابنها، بما في ذلك العنف والتعذيب، ينبغي اعتباره ادعاءات غير مدعومة بالأدلة، إذ إن السيد كوربانوف لم يذكر هذه الادعاءات لا أثناء التحقيق ولا أمام المحكمة.

6.7 As to the author's claim that her son was denied the right of appeal, the Committee notes that Mr. Kurbanov was represented by privately obtained counsel, who did not file a regular cassation appeal.
