By definition any reservation " purports to exclude or modify the legal effect of certain provisions of a treaty or of the treaty as a whole with respect to certain specific aspects in their application " to the author of the reservation; therefore, the definition of the object and purpose of the treaty should not be so broad as to impair the right to formulate reservations.
وأي تحفظ، بحكم تعريفه، يهدف " إلى استبعاد أو تعديل الأثر القانوني لأحكام معينة من معاهدة أو للمعاهدة ككل فيما يتعلق ببعض الجوانب المحددة عند تطبيق هذه الأحكام " على الدولة التي تصدر التحفظ() ومن ثم ينبغي ألا يتسع تعريف الموضوع والغرض بحيث يؤدي إلى شل القدرة على إبداء التحفظات.
