Each State party shall take such measures as may be necessary to establish its jurisdiction over the offences referred to in article 4 in the following cases:

4 - تتخذ كل دولة طرف ما يلزم من تدابير لإقامة ولايتها القضائية على الجرائم المشار إليها في المادة 2 في الحالات التي يكون فيها المدعى ارتكابه الجريمة موجودا في إقليمها وفي حالات عدم تسليمه إلى أي من الـدول الأطراف التي أقامت ولايتها القضائية وفقا للفقرة 1 أو الفقرة 2.

4. Each State Party shall likewise take such measures as may be necessary to establish its jurisdiction over the offences set forth in article 2 in cases where the alleged offender is present in its territory and it does not extradite that person to any of the States Parties which have established their jurisdiction in accordance with paragraph 1 or 2 of the present article.

Each State party shall likewise take such measures as may be necessary to establish its jurisdiction over the offences set out in this article in cases where the alleged offender is present in its territory and it does not extradite such person to any of the States parties which have established their jurisdiction in accordance with paragraphs 1 or 2 of this article.
5- تتخذ كل دولة طرف ما يلزم من التدابير لإقامة ولايتها القضائية على الجرائم المنصوص عليها في هذه المادة في الحالات التي يكون فيها الشخص المدعى ارتكابــه الجريمــة موجوداً في إقليمها ولا تسلمه إلى أي من الدول الأطراف التي أقامت ولايتها القضائية وفقا للفقرة 1 أو 2 من هذه المادة.

5- تتخذ كل دولة طرف ما يلزم من التدابير لإقامة ولايتها القضائية على الجرائم المنصوص عليها في هذه المادة في الحالات التي يكون فيها الشخص المدعى ارتكابــه الجريمــة موجودا في إقليمها ولا تسلمه إلى أي من الدول الأطراف التي أقامت ولايتها القضائية وفقا للفقرة 1 أو 2 من هذه المادة.

23. With regard to article 5 of the Convention, under the terms of paragraph 1 of which each State party undertakes to take such measures as may be necessary to establish its jurisdiction over the offences referred to in article 4, judicial jurisdiction over the offences referred to in article 4 is vested in the following bodies: the sharia courts and the Board of Grievances.
23- إن ما تضمنته الفقرة 1 من المادة 5 من الاتفاقية من " اتخاذ كل دولة طرف ما يلزم من الإجراءات لإقامة ولايتها القضائية على الجرائم المشار إليها في المادة 4 ... " ، فإن الولاية القضائية للجرائم المشار إليها في المادة 4 من اختصاص الجهات الآتية: المحاكم الشرعية وديوان المظالم.
